Article 834. Consequences of an increase in insurance risk during the period of validity of the contract of the Civil Code of the Republic of Kazakhstan
1. During the period of validity of the property insurance contract, the policyholder (the insured) is obliged to immediately inform the insurer of significant changes that have become known to him in the circumstances communicated to the insurer at the conclusion of the contract, if these changes may significantly affect the increase in insurance risk.
In any case, the changes stipulated in the insurance contract are considered significant.
2. The insurer, notified of the circumstances leading to an increase in insurance risk, has the right to demand changes in the terms of the contract or payment of an additional insurance premium commensurate with the increase in risk.
If the policyholder or the Insured objects to changing the terms of the insurance contract or the additional payment of the insurance premium, the insurer has the right to demand termination of the contract in accordance with the rules provided for in Chapter 24 of this Code.
3. If the policyholder or the insured fails to fulfill the obligation provided for in paragraph 1 of this Article, the insurer has the right to demand termination of the contract and compensation for losses caused by the termination of the contract.
4. The insurer has no right to demand termination of the contract if the circumstances leading to an increase in the insured risk have already disappeared.
5. In the case of personal insurance, the consequences of a change in the insurance risk during the term of the contract specified in paragraphs 2 and 3 of this article may occur if they are expressly provided for in the contract.
