Article 920. Infliction of harm in a state of extreme necessity of the Civil Code of the Republic of Kazakhstan
Harm caused in a state of extreme necessity, that is, to eliminate the danger threatening the causer himself or other persons, if this danger could not be eliminated by other means under the circumstances, must be compensated by the person who caused the harm.
Taking into account the circumstances in which such harm was caused, the court may impose the obligation to compensate for it on the third person in whose interests the harmer acted, or on this third person and the harmer in a shared manner, and also release both this third person and the harmer from compensation in whole or in part.
