The signals must be understandable to the driver and given in a timely manner so that their execution does not create an emergency situation.

     The public danger of this administrative offense lies in the fact that when it is committed, serious obstacles are created to the implementation of legislative and other regulatory legal acts regulating issues of road safety in accordance with the established procedure.

     A common object of an administrative offense is public relations in the field of road safety and the legitimate activities of officials responsible for ensuring compliance with traffic rules.

     The objective side of part 1 of the commented article is characterized by one qualifying sign of an offense in the form of failure to comply with a legal requirement to stop. Moreover, legitimate claims will be recognized if they are presented.:

     1) employees of the internal affairs bodies (police);

     2) military police officers, if these requirements are directed against the driver driving a vehicle of the national security agencies, the Armed Forces of the Republic of Kazakhstan, other troops and military formations of the Republic of Kazakhstan.

     Based on paragraph 11, paragraph 2, Article 5 of the Law of the Republic of Kazakhstan dated April 23, 2014 No. 199-V "On Internal Affairs Bodies of the Republic of Kazakhstan", police officers are authorized to stop and inspect vehicles.

     In order to ensure the safety of traffic of vehicles of the national security agencies, the Armed Forces, other troops and military formations of the Republic of Kazakhstan, military police bodies are endowed with similar rights on the basis of the Law of the Republic of Kazakhstan dated February 21, 2005 No. 32 "On Military Police bodies".

     The procedure for stopping vehicles is regulated by the appendix to this article.

     The objective side of part 2 of the article under consideration is characterized by one qualifying sign of an offense, and consists in illegal actions in the form of failure to comply with the lawful requirement of an employee of the transport control authorities to stop a vehicle. Moreover, an administrative offense will be recognized if it is committed at transport control posts in the territory of the Republic of Kazakhstan.

     In accordance with the Law of the Republic of Kazakhstan dated July 4, 2003 "On Road Transport", transport control officers carry out their activities at special posts. 18-1 of this law, a transport control post is a stationary or mobile checkpoint equipped with technical means of control, equipped with a capital building or special vehicles.

     The rules for organizing the work of transport control posts in the territory of the Republic of Kazakhstan were approved by the Order of the Acting Minister of Transport and Communications of the Republic of Kazakhstan dated August 13, 2010 No. 362. This order defines the mechanism of operation of transport control posts. According to clauses 2 and 9 of clause 5 of these Rules:

     1) mobile transport control post – a transport control post organized on the basis of special vehicles, which is equipped with technical means of control, communications and equipment;

     2) stationary transport control post – a transport control post equipped with a capital building and equipped with technical means of control, communications and equipment.

     The initial conduct of transport control by an employee of the post is provided in the following order:

     1) stops a vehicle (trucks, specialized and special vehicles) in the field of view of the security cameras of the post, by giving a signal using a loudspeaker device, a hand gesture or a baton aimed at the vehicle, with a simultaneous whistle signal, which must be understandable to the driver, and given in a timely manner so that their execution does not created an emergency situation;

     2) immediately approaches the vehicle, introduces himself, explains the reasons for stopping the vehicle and presents, at the request of the driver, for familiarization and identification of the last name and position, an official identification card without handing it over to the driver.

     No more than 3 vehicles may be stopped and checked simultaneously at stationary transport control posts, and no more than 2 vehicles may be checked at mobile transport control posts. However, this procedure does not apply to convoys, foreign motor vehicles, vehicles carrying dangerous goods and having appropriate identification marks, vehicles whose violations are recorded by the SAIC, road trains, designed and intended specifically for the transportation of bulky and (or) heavy goods.

The objective side of Part 3 of the analyzed article is characterized by an unlawful act provided for in part one of this article, committed repeatedly within a year after the imposition of an administrative penalty.

     The sanction of this part of the article under study provides for only one non-alternative administrative penalty in the form of deprivation of the right to drive vehicles for a period of six months. In this regard, an answer should be given to the question: "What should a judge do when determining an administrative penalty against persons specified in part 4 of Article 46 of the Administrative Code, namely, persons who use these funds due to disability?". Unfortunately, no regulatory act provides an answer to this question, therefore, it should be assumed that a person using a vehicle due to disability is not a subject of administrative responsibility under part 3 of Article 613 of the Administrative Code, but is the subject of an administrative offense. In this regard, a person using a vehicle due to disability should be involved in accordance with paragraph 1 of this article as a person who has committed such an act for the first time.

     The objective side of part 4 of the article under study is characterized by an unlawful act in the form of failure to comply with a legal requirement to undergo an examination for alcohol, narcotic and (or) substance abuse intoxication in accordance with the established procedure. Moreover, legitimate claims will be recognized if they are presented.:

     1) employees of the internal affairs bodies (police);

     2) military police officers, if these requirements are directed against the driver driving a vehicle of the national security agencies, the Armed Forces of the Republic of Kazakhstan, other troops and military formations of the Republic of Kazakhstan.

     The rules for conducting a medical examination to establish the fact of substance use and intoxication were approved by Order No. 504 of the Minister of Health of the Republic of Kazakhstan dated July 13, 2017. According to these Rules, a medical examination is an outpatient examination of a person in order to establish a state of drug intoxication. Intoxication is a condition that occurs due to acute intoxication with psychoactive substances (alcohol, narcotic drugs, psychotropic substances, precursors, their derivatives and analogues) and is characterized by a complex of mental, behavioral, autonomic and somatoneurological disorders.

     According to paragraph 4, paragraph 3, of Article 54 of the Law of the Republic of Kazakhstan "On Road Traffic", the driver of a mechanical vehicle is required to undergo an intoxication examination at the request of an employee of the internal affairs bodies. Paragraph 1 of the note to article 54 of this law states that "drivers of military vehicles are required to undergo an intoxication examination at the request of military police officers.".

     The official who sent and (or) delivered the person being examined shall take measures to establish his identity (if identification is not possible, photographs of the person being examined may be taken). The medical professional certifies the identity of the person being examined by reviewing his identity documents. The absence of identification documents is not a reason for refusing an examination. In the absence of documents, the conclusion of the medical examination indicates the signs of the person being examined with a mandatory indication of the receipt of data from the words of the person being examined.

     The objective side of part 5 of the article under study is characterized by a repeated unlawful act provided for in part four of this article, committed within a year after the expiration of the administrative penalty.

     Part 4 of this Article provides for only one non-alternative administrative penalty in the form of deprivation of the right to drive vehicles for a period of three years. According to Article 60 of the Administrative Code, the period of deprivation of the right to drive vehicles is calculated in years, months or calendar days.

     That is, if a driver deprived of the right to drive vehicles in accordance with part 4 of Article 613 of the Administrative Code commits a similar administrative offense before the expiration of the administrative penalty, then he should be qualified under part 7 of Article 613 of the Administrative Code as a person deprived of the right to drive vehicles.

     The Regulatory Resolution of the Supreme Court of the Republic of Kazakhstan dated October 6, 2017 No. 7 "On certain issues of application by courts of the norms of the Special Part of the Code of the Republic of Kazakhstan on Administrative Offenses" clarifies some features of determining the status of an offender. If, after executing an administrative penalty in the form of deprivation of the right to drive a vehicle, the driver has not received a driver's license again in accordance with the established procedure, then for the purposes of determining administrative or criminal liability for committing similar offenses, he should be considered as a driver who does not have such a right.

     Thus, if, after the execution of the decision to revoke the right to drive a vehicle, the driver regained such a right in accordance with the procedure established by law, then for committing an offense under part 4 of Article 613 of the Administrative Code within a year after the expiration of the administrative penalty, he is liable under part five of Article 613 of the Administrative Code.

     The objective side of part 6 of the commented article is characterized by a repeated unlawful act provided for in part five of this article, committed within one year after the expiration of the administrative penalty provided for in part five of this article.

     The sanction of the investigated part of the administrative offense provides for two of the most severe administrative penalties in the form of administrative arrest for thirty days and deprivation of the right to drive vehicles for a period of ten years. Moreover, administrative arrest is the main type of penalty here, and deprivation of the right to drive vehicles is an additional one. In cases where administrative arrest cannot be applied due to the provisions of Article 50 of the Administrative Code, deprivation of the right to drive vehicles will be the main type of administrative penalty.

     This procedure for the application of administrative penalties is explained by the Regulatory Resolution of the Supreme Court of the Republic of Kazakhstan dated December 22, 2017 No. 12 "On certain issues of the application by courts of the norms of the General Part of the Code of the Republic of Kazakhstan on Administrative Offenses". If the sanction of the article If the special part of the Administrative Code provides for arrest with additional penalties (for example, expulsion or deprivation of the right to drive vehicles), then courts should release such persons from arrest with reference to Article 50 of the Administrative Code and impose a second penalty provided for by the sanction of the article. The special part of the Administrative Code, if the second part of Article 42 of the Administrative Code allows the application of such a penalty as the main administrative penalty.

     The objective side of part 7 of the article under consideration is characterized by illegal actions provided for in parts four, five and six of this article, committed by a person deprived of the right to drive a vehicle, namely before the expiration of this administrative penalty.

     The sanction of part 7 of Article 613 of the Administrative Code provides for only one non-alternative administrative penalty in the form of administrative arrest for a period of twenty days. It should be noted that this sanction is imperfect, as it does not provide for the procedure for bringing to administrative responsibility persons who are not subject to administrative arrest on the grounds provided for in Article 32 of the Administrative Code. The provisions of part 11 of Article 613 of the Administrative Code cannot be applied, since it is possible to replace the sanction with a fine only for the offenders specified in Article 50 of the Administrative Code.

     The Regulatory Resolution of the Supreme Court of the Republic of Kazakhstan dated December 22, 2016 No. 12 "On some issues of application by courts of the norms of the General Part of the Code of Administrative Offences of the Republic of Kazakhstan" clarifies such features. When considering cases of administrative offenses for which an administrative penalty in the form of administrative arrest is provided, judges should carefully clarify the presence or absence of the circumstances provided for in the second parts of Articles 32 and 50 of the Administrative Code, excluding the use of administrative arrest.

     However, when qualifying an administrative offense, the clarifications of paragraph 27 of the regulatory resolution of the Supreme Court of the Republic of Kazakhstan dated October 6, 2017 No. 7 "On certain issues of the application by courts of the norms of the Special Part of the Code of the Republic of Kazakhstan on Administrative Offenses" should be taken into account. When a driver deprived of the right to drive a vehicle commits an offense provided for in parts one, two and seven of Article 613 of the Administrative Code, the actions of the offender are additionally qualified under part three of Article 612 of the Administrative Code. When driving a vehicle by a driver deprived of the right to drive a vehicle, his actions are qualified under part three of Article 612 of the Administrative Code. Such actions are not subject to additional qualification under Article 669 of the Administrative Code.

     The objective side of part 8 of the commented article is characterized by illegal actions provided for in part seven of this article, committed repeatedly within a year after the expiration of the administrative penalty provided for in part seven of this article.

     The sanction of this norm has the same disadvantages as indicated in the commentary to part 7 of Article 613 of the Administrative Code.

     The objective side of part 9 of the article under study is characterized by illegal actions listed in part four of this article, committed by persons who do not have the right to drive vehicles.

The fourth part of Article 613 of the Administrative Code provides for an administrative sanction in the form of deprivation of the right to drive vehicles for a period of three years for failure to comply with the legal requirement to undergo an examination for alcohol, narcotic and (or) substance intoxication in accordance with the established procedure. As we have already noted, if the period of deprivation of the right to drive expires and the offender does not receive a new right to drive a vehicle, then his status should be defined as persons who do not have the right to drive vehicles.

     The objective side of part 10 of the analyzed article is characterized by illegal actions provided for in part nine of this article, committed repeatedly within a year after the expiration of the administrative penalty provided for in part nine of this article.

     The objective side of part 11 of the article under consideration is characterized by the actions provided for in parts seven, eight and ten of this article, committed by persons to whom administrative arrest in accordance with part two of Article 50 of this Code does not apply.

     According to part 2 of Article 59 of the Administrative Code, administrative arrest cannot be applied.:

     1) pregnant women and women with children under the age of fourteen;

     2) persons under the age of eighteen;

     3) disabled people of groups 1 and 2;

     4) women over the age of fifty-eight;

     5) men over sixty-three years of age;

     6) men who raise children under the age of fourteen alone.

     As you can see, the article does not contain the entire list of offenders who cannot be subjected to administrative punishment in the form of administrative arrest. Part 2 of Article 32 of the Administrative Code states that administrative penalties in the form of deprivation of the right to carry and store firearms and cold weapons and administrative arrest cannot be applied to employees of special state and law enforcement agencies.

     So, on February 28, 2018, the judge of the specialized administrative court of Kostanay, Nasyrova N.S., considering case No. 3228-1800-3/1399 on the violation by a police officer Dandybaev J.U. of Article 613, Part 7 of the Administrative Code for driving, being deprived of the right to drive vehicles, discontinued the proceedings and sent the case to the place of work of the police officer, in order to attract he will be disciplined.

     It can be seen from the case file that Dandybaev J.U. violated the Rules of the road, expressed in "driving a vehicle by a person deprived of the right to drive vehicles" and on the basis of part 2 of art. 32 of the Administrative Code, he must bear administrative responsibility on general grounds.

     Paragraph 27 of the regulatory resolution of the Supreme Court of the Republic of Kazakhstan dated October 6, 2017 No. 7 requires that "When a driver deprived of the right to drive commits an offense under Chapter 30 of the Administrative Code, for which deprivation of the right to drive is also provided: part four of Article 590, ... parts one, two and seven of Article 613 of the Administrative Code. - the actions of the offender are subject to qualification additionally according to the third part of Article 612 of the Administrative Code. When driving a vehicle by a driver deprived of the right to drive a vehicle, his actions are qualified under part three of Article 612 of the Administrative Code."

     Based on the above, it is substantiated that the judge unlawfully terminated the proceedings against Dandybaev Zh.U. Article 821 part 2 states that "Having recognized as a result of the consideration of the case an incorrect legal assessment of what he had done, the body (official) is obliged to change the qualification of the offense to an article or part of an article of the law providing for a less severe administrative penalty."

     In this regard, it is justified that the disposition of part 11 of Article 613 of the Administrative Code should be supplemented with the words "and part 2 of Article 32" after the number "50".

     The objective side of the offense provided for in part 12 of the article under study is characterized by four qualifying features and is expressed in the following illegal actions (omissions):

     1) leaving the driver's cabin (interior) of the vehicle in case of its stop by an employee of the internal affairs bodies without his permission;

     2) failure by the driver to comply with the requirements of an employee of the internal affairs bodies to exit the cabin (cabin) of the vehicle;

     3) the driver driving a military vehicle leaves the cabin (cabin) of the vehicle in case it is stopped by a military police officer without his permission.;

     4) failure by the driver driving a military vehicle to comply with the requirements of a military police officer to exit the cabin (cabin) of the vehicle.

     According to Article 23 of the Law of the Republic of Kazakhstan dated April 17, 2014 No. 194 "On Road traffic", officials of the authorized body exercising state control and supervision in the field of road traffic have the right to allow the driver to leave the cabin (salon) of the vehicle in the absence of a threat to the life or health of an employee of the internal affairs body (illegal behavior, similarity to a wanted person, suspicion of intoxication). When stopping a vehicle at the request of an authorized official, the driver must remain in the cabin (cabin) of the vehicle and exit the cabin only at the request or permission of the official.

     A note to the commented article on the legal grounds and mechanism of legal requirements for stopping a vehicle. Firstly, authorized employees (officials) have this right.:

     1) bodies of internal affairs (police);

     2) transport control authorities;

     3) military police in uniform.

     The requirements for stopping the vehicle must be expressed by:

     1) giving a signal with a hand gesture

     2) giving a signal with a baton and simultaneously blowing a whistle;

     3) Sending a signal using a speaker device.

     Moreover, the signals must be understandable to the driver and given in a timely manner so that their execution does not create an emergency situation.

     According to paragraphs 2 and 3 of section 2 of the Rules of the Road, the driver of a vehicle is obliged, at the request of an employee of the internal affairs bodies, transport control in uniform, to stop the vehicle.:

     1)stop the vehicle;

     2) not to leave the vehicle without taking measures that exclude spontaneous movement of the vehicle, as well as in the event that it is stopped by an employee of the internal affairs bodies without his permission.

     The subjective side of the offense is expressed in the intentional form of guilt.

     The subjects of an administrative offense under this article are individuals driving vehicles who have reached the age of 16.

     They have the right to consider proceedings on administrative offenses provided for in the commented article.:

     1) according to parts two, three, 3-1, four, five, six, seven, eight, nine, ten and eleven - judges of specialized district and equivalent administrative courts (part 1 of art. 684 of the Administrative Code);

     2) according to parts one, twelve and thirteen - chairmen of committees and heads of departments of the Ministry of Internal Affairs, heads of territorial internal affairs bodies, administrative divisions, migration police, local police service of the region, the city of republican significance, the capital, their deputies (paragraph 1 of part 2 of Article 685 of the Administrative Code);

     3) according to parts one and thirteen - heads of departments, police departments, administrative divisions, migration police, local police service of the district (city, district in the city) and their deputies (paragraph 2 of part 2 of Article 685 of the Administrative Code);

     4) in part twelve - employees of the internal affairs bodies (police) with special ranks (paragraph 4 of part 2 of Article 685 of the Administrative Code);

     5) according to parts one, twelve and thirteen, authorized officials of military police bodies (part 1 of Article 727 of the Administrative Code).

     When committing an administrative offense provided for only in the second part of Article 613 of the Administrative Code, police officers have the right to detain, deliver and prohibit the operation of vehicles by delivering them for temporary storage to special sites, parking lots or sites adjacent to a stationary transport control post, including using another vehicle (tow truck), until the elimination of the reasons for the detention (paragraph 1 of Part 1 of Article 797 of the Administrative Code).

     They have the right to initiate proceedings on cases of administrative offenses under the commented article.:

     1) in terms of the second, third, 3-1, fourth, fifth, sixth, seventh, eighth, ninth, tenth and eleventh – the internal affairs bodies (paragraph 1 of Part 1 of Article 804 of the Administrative Code);

     2) in parts two, three, 3-1, four, five, six, seven, eight, nine, ten and eleven - military police bodies of the Armed Forces of the Republic of Kazakhstan on offenses committed by military personnel, conscripts, conscripts, and persons driving vehicles of the Armed Forces of the Republic of Kazakhstan, other troops and military formations of the Republic Kazakhstan (paragraph 4 of Part 1 of Article 804 of the Administrative Code);

     3) in parts two, three, 3-1, four, five, six, seven, seven, eight, nine, ten and eleven - military police bodies of the National Security Committee of the Republic of Kazakhstan on offenses committed by persons driving vehicles of special state bodies (paragraph 5, Part 1 of Article 804 of the Administrative Code);

     5) transport control authorities (paragraph 26 of Part 1 of Article 804 of the Administrative Code);

     On the basis of Article 812 of the Administrative Code, all types of offenses provided for in all parts of 613 of the Administrative Code may also be considered at the place of registration of vehicles, or at the place of residence of the person against whom proceedings on an administrative offense are being conducted.

     Cases of administrative offenses of minors, their parents, or persons replacing them are considered at the place of residence of the person in respect of whom proceedings on the case of an administrative offense are being conducted.
