Limitation of a Citizen’s Legal Capacity
📘 1. General Characteristics of the Norm
Article 27 of the Civil Code of the Republic of Kazakhstan regulates the limitation of legal capacity. This is not a complete deprivation of rights, as in the case of incapacity (Article 26), but rather a partial restriction.
Such a measure is applied to persons who, due to addictions (gambling, alcohol, drugs, etc.), harm their family and place it in a difficult financial situation.
This provision has a protective nature and is aimed at safeguarding:
the interests of the addicted individual (the citizen);
the interests of their family members and dependents;
public interests (preventing negative social consequences).

To limit a citizen’s legal capacity, three conditions must be present simultaneously:

The procedure is regulated by Articles 308–311 of the Civil Procedure Code of the Republic of Kazakhstan.

1. An application to the court may be filed by:
a family member (spouse, parent);
the guardianship and trusteeship authority;
the prosecutor.
2. The court conducts a review and may request:
certificates from a narcological dispensary;
documents confirming debts or penalties;
witness testimonies.
3. Court decision:
to limit the citizen’s legal capacity;
to appoint a trustee (curator) within the framework of Article 128 of the Civil Code of the Republic of Kazakhstan.

If the citizen:
stops abusing alcohol, drugs, gambling, etc.;
eliminates the consequences (for example, repays debts or returns to employment),
then by court decision:
the limitation of legal capacity is cancelled;
trusteeship is terminated.

a certificate from a narcological dispensary;
