Article 27. Administrative procedural legal capacity and administrative procedural legal capacity Administrative Procedural Procedural Code of the Republic of Kazakhstan

     1. The ability to have procedural rights and bear procedural duties in administrative proceedings (administrative procedural legal capacity) is recognized equally for all individuals and legal entities, administrative bodies, and officials if, in accordance with this Code, they have the right to judicial protection of their rights, freedoms, and legitimate interests.

     2. The ability to exercise procedural rights by their actions, including entrusting the management of an administrative case to a representative, and to perform procedural duties in administrative proceedings (administrative procedural capacity) belongs to individuals who have reached the age of eighteen and have not been recognized as legally incompetent, legal entities, administrative bodies, and officials.

     3. Minors who have been emancipated on the grounds provided for by law shall personally exercise their procedural rights and procedural duties from the moment of emancipation.

     4. In cases stipulated by the laws of the Republic of Kazakhstan, in administrative matters arising from public relations, minors between the ages of fourteen and eighteen have the right to personally defend their rights, freedoms and legitimate interests. The court has the right to involve the legal representatives of the minor in such administrative matters.

     5. The rights, freedoms and legitimate interests of a minor between the ages of fourteen and eighteen, as well as a person recognized as having limited legal capacity, are protected in court by their legal representatives, however, the court has the right to involve the minor himself or a person recognized as having limited legal capacity, as well as the prosecutor, in such administrative matters.

     6. The rights, freedoms and legitimate interests of a minor under the age of fourteen, as well as of a person declared legally incompetent, are protected in court by their legal representatives, the prosecutor.
