Decree of the President of the Republic of Kazakhstan dated January 2, 2023 No. 81.

    In accordance with subparagraph 7) of paragraph 1 of Article 16 of the Law of the Republic of Kazakhstan "On Law Enforcement Service", I HEREBY DECREE:

     1. To approve the attached Code of Ethics for employees of Law enforcement agencies, civil protection agencies and the State Courier Service of the Republic of Kazakhstan.

     2. This Decree shall enter into force from the date of its first official publication.

The Code of Ethics for employees of Law enforcement agencies, civil protection agencies and the State Courier Service of the Republic of Kazakhstan

Chapter 1. General provisions

     1. This Code of Ethics for Law Enforcement Officers, Civil Protection Agencies and the State Courier Service of the Republic of Kazakhstan (hereinafter referred to as the Code) has been developed in accordance with subparagraph 7) of paragraph 1 of Article 16 of the Law of the Republic of Kazakhstan "On Law Enforcement Service" and defines common ethical principles and requirements for the conduct of law enforcement officers, civil protection agencies and the state the Courier Service of the Republic of Kazakhstan (hereinafter referred to as employees).

     2. Service in law enforcement agencies, civil protection agencies and the state courier service of the Republic of Kazakhstan is an expression of special trust on the part of society and the state and places high demands on the morality and moral and ethical image of employees.

     The purpose of this Code is to establish uniform requirements for the conduct of employees, taking into account the specifics of the law enforcement service and the restrictions associated with its passage.

     The Code is designed to help strengthen the authority of the law enforcement service, the trust of citizens of the Republic of Kazakhstan in the state, the formation of a high culture of relationships in the law enforcement service and the creation of an atmosphere of integrity, provide a unified moral framework for employee behavior, improve the effectiveness of employees in fulfilling their official duties, and is aimed at preventing cases of unethical employee behavior.

     The successful implementation of the tasks facing law enforcement agencies, civil protection agencies and the state courier service of the Republic of Kazakhstan to respect and protect human and civil rights and freedoms, the legitimate interests of individuals and legal entities, and the state should be carried out only on the basis of high professionalism, honesty and integrity of employees, their independence and impartiality, and their ability to resist any attempts at unlawful influence on the results of professional activity.

     As government officials, employees must be faithful to their oath, deeply aware of their personal responsibility to society and the state, and committed to government policy.

     3. The text of the Code is placed in the buildings of law enforcement agencies, civil protection agencies and the State courier service of the Republic of Kazakhstan in places accessible to the public.

     4. The requirements of professional ethics established by this Code are mandatory for all employees.

     After joining the service of law enforcement agencies, civil protection agencies and the state courier service of the Republic of Kazakhstan, a person is subject to a written review of the text of this Code within three days.

Chapter 2. Ethical principles of law enforcement service

     5. The professional ethics of employees is based on the ethical principles of public service established in the Ethical Code of Civil Servants of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated December 29, 2015 No. 153, and special ethical principles of law enforcement service.

     6. Special ethical principles of the law enforcement service include:

     1) officer's honor is the main internal dignity of an employee, his valor, nobility of soul and a clear conscience, the reputation of an honest employee, a good name, personal authority, which are manifested in loyalty to civil and official duties, accepted moral obligations.;

     2) high morality is an awareness of the meaning of the concept of honor for oneself and subordinates, an increased sense of justice, moral purity and spirituality, a meaningful attitude towards professional duties as duties that are highly socially useful and necessary.;

     3) benevolence is a kind attitude towards a person and a citizen, a willingness to promote their well–being, and to proceed from an unbiased personal attitude when communicating with people.;

     4) Self–discipline is the ability to make decisions and take actions regardless of emotional state.;

     5) humanity is humanity, willingness to come to the rescue, never to use the current situation and the helplessness of victims for selfish purposes, recognition of universal human rights for everyone, without exception.

Chapter 3. General requirements for employees

     7. Employees, realizing their responsibility to citizens, society and the state, must:

     1) strictly observe the Constitution, laws and other regulatory legal acts of the Republic of Kazakhstan, honor and respect the state symbols of the Republic of Kazakhstan;

     2) to combat any violations of the law, no matter by whom they are committed, to take timely and effective measures to protect legally protected human and civil rights and freedoms, as well as the interests of society and the state, to seek the elimination of violations of the law and the restoration of violated rights;

     3) contribute by their actions to strengthening the authority of state power, the trust of citizens and society in the institutions of the state;

     4) to ensure the observance and protection of the rights, freedoms and legitimate interests of man and citizen, the legally protected interests of legal entities, society and the state, to prevent actions involving their violation, to respond sensitively to complaints;

     5) respect the honor and dignity of a person and citizen regardless of origin, social, official and property status, gender, race, nationality, language, attitude to religion, beliefs, place of residence and other circumstances;

     6) to prevent the commission of actions capable of discrediting the Republic of Kazakhstan, government authorities, law enforcement agencies, causing a negative public response, to refrain from behavior that may harm their reputation;

     7) contribute to strengthening the unity of the people of Kazakhstan and interethnic and interfaith harmony in the country;

     8) respect the official and other languages, traditions and customs of the people of Kazakhstan;

     9) constantly improve professional qualifications, general education and cultural level, observe generally accepted principles and norms of morality, strive to meet the needs of society, become a model of high intelligence and culture in the service and at home;

     10) We must constantly remember that only a trained and qualified employee can benefit society, improve their skills, improve through professional training, strive to be comprehensively developed, highly educated, and use best practices competently in the service.;

     11) be modest, exclude corruption risks, do not emphasize or use your official position;

     12) avoid relationships that could compromise an employee's high rank;

     13) be demanding of yourself, principled, truthful, refrain from financial and business relationships that may affect the impartiality and objectivity of the performance of professional duties;

     14) to ensure the safety of state property, to use state property only for its intended purpose for the performance of official duties;

     15) to use his official position solely to achieve state interests.

     16) refrain from visiting gambling establishments, except in cases related to the performance of official duties.

Chapter 4. Requirements for employees in connection with the performance of their official duties

     8. Employees in their professional activities must:

     1) to carry out their functions honestly, fairly and impartially, to use the powers granted by the state reasonably, strictly within the framework of the law, and to strive to strengthen the rule of law and the rule of law;

     2) Take all measures prescribed by law to identify and eliminate violations of the rule of law, the causes and conditions that contributed to them, and restore violated rights.;

     3) to recognize the priority of state and official interests over personal interests in their professional activities;

     4) take measures to prevent corruption offenses, prevent the commission of corruption offenses, resist and be intolerant of any manifestations of corruption, no matter from whom they originate;

     5) immediately inform the management about cases of corruption offenses that have become known to them, as well as about the facts of any persons contacting them in order to incite them to commit corruption offenses.;

6) to show impartiality in decisions, not to allow them to be influenced by any prejudice, hostile or friendly relations, nationality and religion;

     7) strictly observe the restrictions and prohibitions established by the laws of the Republic of Kazakhstan, as well as the requirements related to service;

     8) take measures provided for by the legislation of the Republic of Kazakhstan to prevent and resolve conflicts of interest;

     9) to prevent the disclosure of official and other legally protected information, as well as to prevent such facts from other persons;

     10) to show humanity, to be courageous and courageous, not to stop in the face of danger in an environment that requires saving people's lives.;

     11) to prevent violations of the standards of professional ethics by colleagues and other government employees;

     12) do not give rise to criticism from the public, do not allow prosecution for it, and if the criticism is justified, use it to eliminate shortcomings.;

     13) possess moral and psychological stability, self-control, observe subordination, maintain friendly relations with colleagues, show correctness and care in dealing with individuals;

     14) in relations with representatives of state authorities, local governments, public associations, commercial and non-profit organizations, maintain independence, show tact and respect, be demanding and principled.;

     15) to wear a uniform with honor and dignity, to observe the rules of its wearing.

Chapter 5. Requirements for employees holding senior positions in law enforcement agencies, civil protection agencies and the State courier service of the Republic of Kazakhstan

     9. The following requirements apply to employees holding senior positions in law enforcement agencies, civil protection agencies and the State courier service of the Republic of Kazakhstan:

     1) the ability to combine management effectiveness, promote the establishment and maintenance of a healthy moral and psychological climate in the team, form the moral culture of employees, take care of subordinates, ensure their social and legal protection;

     2) When determining the scope and nature of work, be guided by the principles of fairness, taking into account the personal and business qualities, qualifications and work experience of subordinate employees.

     3) to prevent the creation of unlawful obstacles in the promotion of subordinates, the facts of a biased approach to assessing professional, business and personal qualities during encouragement, certification, not to allow rudeness, tactlessness and humiliation of human dignity.;

     4) not to force subordinates to commit illegal offenses that are incompatible with generally accepted moral and ethical standards;

     5) to preserve and honor the best service traditions of employees: patriotism, courage and selflessness, nobility and self-sacrifice, sensitivity to human needs and grief, loyalty to duty, skill and professionalism;

     6) to foster a high general and professional culture among subordinates, to be an example of strict compliance with the requirements of this Code.;

     7) eliminate cases of recruitment and placement of personnel based on kinship, community and personal loyalty, and be guided by the principle of meritocracy.;

     8) provide support and assistance to young professionals in acquiring professional skills.

Chapter 6. Requirements for employees when making public appearances

     10. Public statements on the activities of law enforcement agencies, civil protection agencies and the state courier service of the Republic of Kazakhstan are carried out by their heads or officials authorized by them.

     Employees should conduct discussions in a correct manner, without undermining the authority of law enforcement agencies, civil protection agencies and the state courier service of the Republic of Kazakhstan and government authorities.

     11. Employees should not publicly express their opinions on public policy and performance issues if they:

     1) does not correspond to the main directions of state policy;

     2) discloses official information that is not allowed to be made public.;

     3) It contains unethical statements addressed to government officials, public administration bodies, law enforcement officers, civil protection bodies and the State courier service of the Republic of Kazakhstan, civil servants, individuals and legal entities.

Chapter 7. Responsibility of employees for violation of the requirements of this Code

     12. Employees are responsible for non-fulfillment or violation of the requirements stipulated by this Code in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
