On approval of the Rules for the establishment of expert commissions (expert groups) and the involvement of specialists (experts) (specialized institutes and organizations) to participate in the comprehensive non-departmental expertise of construction projects, as well as the comprehensive urban planning expertise of urban projects

In accordance with subparagraph 49) of Article 24 of the Building Code of the Republic of Kazakhstan, I ORDER:

     1. Approve:

     1) Rules for the establishment of expert commissions (expert groups) and the involvement of specialists (experts) (specialized institutes and organizations) to participate in the comprehensive non–departmental expertise of construction projects, as well as the comprehensive urban planning expertise of urban development projects (hereinafter referred to as the Rules), in accordance with Appendix 1 to this order;

     2) A list of certain orders that have become invalid, in accordance with Appendix 2 to this order.

     2. The Committee on Construction and Housing and Communal Services of the Ministry of Industry and Construction of the Republic of Kazakhstan, in accordance with the procedure established by law, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Industry and Construction of the Republic of Kazakhstan after its official publication.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Industry and Construction of the Republic of Kazakhstan.

     4. This order will enter into force on July 1, 2026 and is subject to official publication.

     5. To establish that from July 1, 2028, subparagraph 4) of paragraph 2 of the Rules is valid as follows:

     "4) specialist – a qualified specialist with special knowledge in the relevant industry and is on the staff of a state expert organization, expert organization or engaged on a contractual basis to participate in the work of expert commissions (expert groups) on the relevant sections (parts) of construction and (or) urban development projects, the activities of which are not subject to certification;".

Appendix 1 to the Order of the Minister of Industry and Construction of the Republic of Kazakhstan dated April 27, 2026 No. 205

 

Rules for the establishment of expert commissions (expert groups) and the involvement of specialists (experts) (specialized institutes and organizations) to participate in the comprehensive non-departmental expertise of construction projects, as well as the comprehensive urban planning expertise of urban projects

Chapter 1. General provisions

     1. These Rules for the establishment of expert commissions (expert groups) and the involvement of specialists (experts) (specialized institutes and organizations) to participate in the comprehensive non–departmental expertise of construction projects, as well as the comprehensive urban planning expertise of urban projects (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 49) of Article 24 of the Building Code of the Republic of Kazakhstan and determine the procedure:

     1) creation by expert organizations and the state expert organization of expert commissions (expert groups), involvement of specialists (experts) (specialized institutes and organizations) to participate in a comprehensive non-departmental examination of construction projects;

     2) creation by the state expert organization of expert commissions (expert groups), involvement of specialists (experts) (specialized institutes and organizations) to participate in the urban planning expertise of urban development projects.

     2. The basic concepts used in these Rules:

     1) state expert organization is a legal entity established by decision of the Government of the Republic of Kazakhstan in the organizational and legal form of a republican state enterprise on the right of economic management and carrying out project expertise activities attributed to the state monopoly, as well as carrying out other activities provided for by the laws of the Republic of Kazakhstan;

     2) an expert organization is a legal entity accredited in accordance with the procedure established by this Code, which carries out a comprehensive non–departmental expert examination of construction projects that are not classified by the legislation of the Republic of Kazakhstan as a state monopoly.;

     3) project expertise is an expert activity that analyzes and evaluates the quality of construction projects and urban planning projects by establishing the compliance (non–compliance) of design solutions with the conditions of the initial materials and permits for design provided for by the legislation of the Republic of Kazakhstan, as well as compliance in design solutions and calculations with the requirements of urban planning and technical regulations, norms and regulations of the state and interstate regulatory documents;

     4) specialist – a qualified specialist with special knowledge in the relevant industry and is on the staff of a state expert organization, expert organization or engaged on a contractual basis to participate in the work of expert commissions (expert groups) on the relevant sections (parts) of construction and (or) urban development projects, the activities of which are not subject to certification (attestation);

     5) specialized institute or organization – scientific research institutes, design or survey organizations, as well as other organizations involved in the work of expert commissions (expert groups) on the relevant sections (parts) of construction and (or) urban development projects.

     3. Members of the expert commissions (expert groups) specified in paragraphs 5 and 12 of these Rules may not disclose official information obtained during the examination of projects, unless otherwise provided by the laws of the Republic of Kazakhstan.

Chapter 2. The procedure for creating expert commissions (expert groups) and attracting specialists (experts) (specialized institutes and organizations) to participate in the comprehensive non-departmental expertise of construction projects, as well as the comprehensive urban planning expertise of urban projects

Paragraph 1. Procedure for the establishment of expert commissions (expert groups) and the involvement of specialists (experts) (specialized institutes and organizations) to participate in a comprehensive non-departmental examination of construction projects

     4. To conduct a comprehensive non-departmental examination of construction projects, an expert organization or a state expert organization creates expert commissions (expert groups).

     5. The expert commissions (expert groups) include full-time experts and specialists in the relevant sections (parts) of the construction project, as well as, if necessary, experts engaged on a contractual basis to participate in a comprehensive non-departmental examination of construction projects.

     6. An expert organization or a state expert organization, if necessary, involves specialists or specialized institutes or organizations in expert commissions (expert groups) on a contractual basis, in cases of conducting a comprehensive non-departmental expertise on projects of unique construction sites, as well as other construction sites in terms of the use of materials, products, equipment and technologies that require availability (concentration). special, highly specialized knowledge and experience.

     7. Specialists or specialized institutes or organizations engaged on a contractual basis shall provide a report with a recommendation and assessment of design solutions to experts when conducting a comprehensive non-departmental examination of construction projects, in accordance with the procedure and terms stipulated by the contract concluded with the state expert organization or expert organizations.

     8. When concluding relevant contracts with the involved specialists or specialized institutes or organizations, the necessary condition is:

     For specialists, it is necessary to have documents confirming their professional education and qualifications, or practical activities in relevant domestic and (or) foreign specialized institutes and (or) organizations.;

     for specialized institutions or organizations, the availability of documents confirming the implementation of activities corresponding to the purpose of the construction project for which these specialized institutions or organizations are involved.

Paragraph 2. Procedure for the establishment of expert commissions (expert groups) and the involvement of specialists (experts) (specialized institutes and organizations) to participate in the comprehensive urban planning expertise of urban development projects

     10. The state expert organization creates expert commissions (expert groups) to conduct a comprehensive urban planning examination of urban development projects.

     11. The expert commissions (expert groups) include full-time experts and specialists in the relevant sections (parts) of the urban development project, as well as, if necessary, experts engaged on a contractual basis to participate in the comprehensive urban planning expertise of urban development projects.

     12. If necessary, a state expert organization involves specialists or specialized institutes or organizations in expert commissions (expert groups) on a contractual basis, in cases requiring the availability (concentration) of special, highly specialized knowledge and experience.

13. Specialists or specialized institutes or organizations engaged on a contractual basis shall provide a report with a recommendation and assessment of design solutions to experts when conducting a comprehensive urban planning examination of urban development projects, in accordance with the procedure and terms stipulated by the contract concluded with the state expert organization.

     14. When concluding relevant contracts with the involved specialists or specialized institutes or organizations, the necessary condition is:

     For specialists, it is necessary to have documents confirming their professional education and qualifications, or practical activities in relevant domestic and (or) foreign specialized institutes and (or) organizations.;

     for specialized institutions or organizations, the availability of documents confirming the implementation of activities corresponding to the purpose of the urban development project for which these specialized institutions or organizations are involved.
