Article 87. Objects of the state ecological expertise of the Ecological Code of the Republic of Kazakhstan
The following objects of state environmental expertise are subject to mandatory state environmental expertise:
1) design documentation for the construction and (or) operation of facilities of categories I and II and other design documents provided for in this Code for obtaining environmental permits;
In the event of a change in the deadlines for the performance of work specified in previously agreed design documents during the exploration of hydrocarbons, with the exception of design documents during the exploration of hydrocarbons in subsurface areas carried out at sea, provided that the design decisions remain unchanged and the requirements of paragraph 7 of Article 76 of this Code are met, repeated state environmental assessment is not required.;
2) design documentation for the construction and (or) operation of Category III facilities and other design documents provided for in this Code necessary for the preparation of an environmental impact statement;
3) drafts of regulatory legal acts of the Republic of Kazakhstan developed by central state bodies and local government bodies, the implementation of which may lead to negative impacts on the environment;
4) projects of natural science and feasibility studies for the creation and expansion of specially protected natural territories, including their functional zoning and master plans for infrastructure development, the transfer of lands of specially protected natural territories to reserve lands, the abolition or reduction of territories of state nature reserves of republican and local significance and state protected areas of republican significance, management plans an environmental organization, developed in accordance with the Law of the Republic of Kazakhstan "On Specially Protected Natural Territories";
5) survey materials of territories justifying the classification of these territories as zones of ecological disaster or environmental emergency;
6) projects of economic activity that may have an impact on the environment of neighboring states or for which it is necessary to use natural objects shared with neighboring states or which affects the interests of neighboring states, including the "Baikonur" complex, defined by international treaties of the Republic of Kazakhstan;
The procedure and mechanism for assessing the environmental impact in the areas of impact of the separating parts of launch vehicles are determined according to the methodology approved by the authorized body in the field of environmental protection.;
7) materials from a comprehensive environmental survey of lands where nuclear weapons tests were conducted in the past, as well as those that were exposed to military ranges;
8) forest management projects of state forest holdings and forest management and (or) special surveys for categorizing the state forest fund, transferring it from one category to another, as well as allocating specially protected areas where forest use is prohibited or restricted;
9) design and other documents for types of activities that do not require an environmental permit, for which the laws of the Republic of Kazakhstan provide for the mandatory availability of a positive conclusion of the state environmental assessment.
For the objects of the state environmental assessment specified in subparagraph 1) of this paragraph, the state environmental assessment is carried out as part of the procedure for issuing environmental permits and a separate conclusion of the state environmental assessment is not issued.
