Article 111. Rights, duties and responsibilities of subjects of expert activity in the field of design of the Building Code of the Republic of Kazakhstan

1. The rights and obligations of the state expert organization and expert organizations are established by this Code and other laws of the Republic of Kazakhstan.

2. An expert in the field of design has the right:

1) participate in the examination of projects as part of expert commissions (expert groups);

2) request and receive necessary materials and information from the project examination customers;

3) to carry out an expert examination of projects in separate sections (parts) according to the specialization specified in the expert's certificate for the right to engage in expert activity in the field of design, and to draw up the relevant parts of the expert opinion on them.;

4) initiate the withdrawal by a state expert organization or an expert organization of previously issued expert opinions in the cases provided for by this Code.;

5) engage in pedagogical, scientific and (or) other creative activities.

3. An expert in the field of design is prohibited from:

1) to conduct an expert examination of projects in the preparation of which this expert was directly or indirectly involved or carried out with the participation of a spouse and (or) close relatives, as well as to issue expert opinions not established by this Code.;

2) engage in other types of entrepreneurial activities related to architectural, urban planning and construction activities;

3) be in labor, financial and (or) other dependent relationships with other subjects of architectural, urban planning and construction activities.

Violation of the requirements of this paragraph by an expert in the field of design, if it does not contain signs of a criminal offense or an administrative offense, entails the imposition of disciplinary action in the manner prescribed by the laws of the Republic of Kazakhstan in the form of a warning about incomplete official compliance or termination of the employment contract at the initiative of the employer.

4. An expert in the field of design is obliged to:

1) to be on the staff of a state expert organization or one of the expert organizations in order to carry out professional activities;

2) to observe confidentiality and ensure official and commercial secrets during the examination of projects, unless otherwise provided by the laws of the Republic of Kazakhstan;

3) systematically improve their professional qualifications;

4) observe professional ethics;

5) to carry out procedures and operations for the examination of the project on the site of the portal for the organization of the development and examination of projects on the principle of "one window" in accordance with the procedure determined by the authorized body for architecture, urban Planning and construction.

5. In case of revealing the facts of poorly conducted project expertise, the subjects of expert activity in the field of design are responsible in accordance with the laws of the Republic of Kazakhstan.

For substandard construction projects or urban development projects that have a positive expert opinion, the subjects of expert activity in the field of design are responsible along with the relevant developers of construction projects or urban development projects.
