On approval of the Rules for the formation by sectoral government agencies of lists of trusted high-risk artificial intelligence systems and their publication on the Internet resources of government agencies

 In accordance with paragraph 1 of Article 19 of the Law of the Republic of Kazakhstan "On Artificial Intelligence", I ORDER:

     1. To approve the attached Rules for the formation by sectoral government agencies of lists of trusted high-risk artificial intelligence systems and their publication on the Internet resources of government agencies.

     2. The Committee of Digital Assets and Breakthrough Technologies of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order, submit to the Legal Department of the Ministry of Artificial Intelligence and Digital Development of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for the formation by sectoral government agencies of lists of trusted high-risk artificial intelligence systems and their publication on the Internet resources of government agencies

Chapter 1. General provisions

     1. These Rules for the formation by sectoral government agencies of lists of trusted high-risk artificial intelligence systems and their publication on the Internet resources of government agencies (hereinafter referred to as the Rules) have been developed in accordance with paragraph 1 of Article 19 of the Law of the Republic of Kazakhstan "On Artificial Intelligence", and determine the procedure for the formation by sectoral government agencies of lists of trusted high–risk artificial intelligence systems. the degree of risk and their publication on the Internet resources of government agencies.

     2. The following concepts are used in these Rules:

     1) artificial intelligence is a functional ability to simulate cognitive functions characteristic of humans, providing results comparable to or superior to the results of human intellectual activity;

     2) an artificial intelligence system is an object of informatization that operates on the basis of one or more artificial intelligence models.

     3. Lists of trusted high-risk artificial intelligence systems are formed by sectoral government agencies in order to ensure trust and disseminate best practices in the application of artificial intelligence systems in the relevant industry (sphere) and are published on an ongoing basis on the Internet resources of government agencies.

Chapter 2. The procedure for the formation by sectoral government agencies of lists of trusted high-risk artificial intelligence systems and their publication on the Internet resources of government agencies

     4. The formation of lists of trusted high-risk artificial intelligence systems and their publication on the Internet resources of government agencies (hereinafter referred to as the Lists) is carried out by sectoral government agencies based on applications from owners and (or) owners of high–risk artificial intelligence systems.

     5. In order to include a high-risk artificial intelligence system in the List, its owner and/or owner submits the following documents to the branch government agency:

     application form according to Appendix 1 to these Rules;

     certificate of information entry in the State Register of Copyrighted Objects and (or) copyright agreement;

     The audit report is in accordance with the Rules for Auditing Information Systems, approved by the Order of the Minister of Information and Communications of the Republic of Kazakhstan dated June 13, 2018 No. 263 (registered in the Register of State Registration of Regulatory Legal Acts under No. 17141).

     6. The branch government body, within a period not exceeding ten working days from the date of receipt of the application and the full package of documents, reviews the submitted materials for:

     completeness of filling out the application in accordance with Appendix 1 to these Rules, including the indication of the name of the artificial intelligence system, its purpose and scope of application, as well as a description of the functionality, goals and conditions of use of the system;

     the applicant has a certificate of registration in the State Register of Copyrighted Objects and (or) a copyright agreement;

     the availability of a positive audit report of a high-risk artificial intelligence system, as well as the compliance of the information specified in the audit report with the information provided in the application.

     7. If the package of documents complies with paragraph 6 of these Rules, the branch government agency includes the artificial intelligence system in the List and within five working days posts the relevant information on its official Internet resource in accordance with Annex 2 to these Rules.

     Information is posted on the official Internet resource of the branch government agency by publishing the List in open access on the web page of the official Internet resource of the branch government agency, intended for posting regulatory and reference materials, with the possibility of viewing (familiarization) and downloading (if available) The list. When updating the List, an updated version of the List is posted on the official Internet resource of the branch government agency.

     8. If a package of documents is found to be inconsistent, the branch government agency sends the applicant a notification of the non-compliance of the submitted documents with paragraph 6 of these Rules.

     In case of elimination of the identified inconsistencies, the applicant has the right to resubmit the package of documents, while the review of the resubmitted documents is carried out by the branch state body within a period not exceeding five working days from the date of re-receipt of the application and the full package of documents, in accordance with paragraph 5 established by these Rules.
