Article 11. Provision of infrastructure facilities to settlements and creation of conditions for their accessibility of the Law on Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan

1. Urban planning documentation on the planning and development of a settlement or part of it (urban planning projects) should determine the composition and structure of social, industrial, recreational, engineering and transport infrastructure facilities, as well as provide for:

1) landscaping, landscaping, engineering preparation of the territory and necessary easements, taking into account the type (role) of the settlement;

2) complex development of the territory;

3) taking into account the interests of various social, demographic and professional groups of the population;

4) compliance with regulatory requirements (restrictions, conditions);

5) development of a competitive environment in the service sector.

2. Settlements should be provided with optimal conditions and means of access for all categories of the population (including persons with disabilities and other low-mobility groups) to workplaces, common areas, facilities (facilities, communications) of social, recreational, engineering and transport infrastructure in accordance with the type of settlement and the conditions of the area.

3. Urban planning documentation for settlements should contain sections on creating conditions for meeting the needs of people with disabilities and other low-mobility groups in social and recreational infrastructure facilities.

4. Changing the purpose of public service facilities, which entails a reduction in the level of service established by state regulations, is not allowed.

5. When developing urban planning documentation, designing and building settlements, a unified system of transport communications and a street and road network should be provided, interconnected with the planning structure of the settlement and providing communication with all its functional zones (including suburban areas), as well as external transport facilities.

6. The project documentation for the development (arrangement, building) of interuniverse territories for the subsequent implementation of economic and (or) other activities related to the stay of people should provide for a stable and affordable life support system in this territory, including the construction of infrastructure facilities.

7. When developing design documentation, building, operating and postulating main communications, head structures of engineering infrastructure, as well as carrying out work on engineering preparation of territories, decisions should be made that take into account the interests of adjacent territories and exclude the possibility of exposure of dangerous (harmful) phenomena and processes on the territory and the population.

8. The approved schemes of republican, interregional and regional engineering and transport systems are the basis for the development of design (design and estimate) documentation, as well as activities aimed at the development (associated with the development) of a life support system and the development of settlements.

The Law of the Republic of Kazakhstan dated July 16, 2001 No. 242.

This Law regulates the relations that arise between government agencies, individuals and legal entities in the process of carrying out architectural, urban planning and construction activities in the Republic of Kazakhstan, and is aimed at creating a full-fledged human habitat and vital activity, sustainable development of settlements and interuniverse territories.
