1. Recourse claims from the perpetrators to reimburse the money paid to the victims as compensation are brought by the prosecutor's office as part of representing and defending the interests of the State in court.

2. The money paid to the victims from the Victims Compensation Fund is also subject to recovery by the court from:

1) legal representatives of a minor found guilty of committing a crime;

2) legal entities that, in accordance with the laws of the Republic of Kazakhstan, are financially responsible for damage caused by a criminal offense of an individual;

3) persons in respect of whom criminal prosecution has been terminated on the grounds provided for in paragraphs 3), 4) and 12) of the first part of Article 35 or the first part of Article 36 of the Criminal Procedure Code of the Republic of Kazakhstan;

4) the victim in cases where it is established that he has provided false information in order to receive compensation, as well as the reclassification of criminal offenses to offences not provided for in Article 6 of this Law, and the termination of the criminal case or the entry into force of the acquittal of the court in the absence of a criminal offense event.

This Law defines the legal, economic, social and organizational bases aimed at ensuring the payment of compensation to victims of certain types of criminal offenses.
