Article 120. Documents of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. Documents are recognized as evidence if the information stated or certified in them by individuals, legal entities and officials is relevant to the criminal case.
2. Materials containing factual information about illegal actions obtained in compliance with the requirements of the laws of the Republic of Kazakhstan "On operational investigative activities" and "On Counterintelligence activities" are documents and can be used as evidence in criminal proceedings.
3. The documents may contain information recorded in both written and other forms. The documents include, inter alia, explanations, acts of inventories, audits, certificates, acts of tax audits, conclusions of tax authorities, as well as materials containing computer information, photographs and films, sound and video recordings received, requested or submitted in accordance with the procedure provided for in Article 122 of this Code.
4. The documents are attached to the file and stored in it for the entire duration of its storage. In the event that the seized and attached documents are required for current accounting, reporting and other legitimate purposes at the request of the rightful owner, they may be returned to him or provided for temporary use, including from electronic media, if possible without prejudice to the case, or copies of them, if necessary, certified notary public.
Expenses related to copying and notarization of copies of submitted documents are carried out at the expense of the initiator of the petition.
Documents that are not relevant to the criminal case are returned to their rightful owner.
5. In cases where documents have the features specified in Article 118 of this Code, they are recognized as material evidence.
