Article 20. Protection of the territory of the Republic of Kazakhstan from the introduction and spread of infectious and exotic animal diseases from other states of the Law on Veterinary Medicine

Article 20. Protection of the territory of the Republic of Kazakhstan from the introduction and spread of infectious and exotic animal diseases from other states of the Law on Veterinary Medicine

     1. The objects being moved (transported) at the crossing of the customs border of the Eurasian Economic Union and (or) the State Border of the Republic of Kazakhstan and (or) at the places of delivery, places of completion of customs clearance, as well as at veterinary control posts are subject to mandatory state veterinary and sanitary control and supervision.

     2. Import and transit of transported (transported) objects from other epizootic-safe countries is allowed on the territory of the Republic of Kazakhstan, in compliance with veterinary (veterinary and sanitary) rules established by the authorized body, international treaties of the Republic of Kazakhstan and acts constituting the law of the Eurasian Economic Union.

     3. The import, export and transit of the objects being moved (transported) are carried out in accordance with the assessment of the epizootic situation of the respective territories.  

     4. For the implementation of state veterinary and sanitary control and supervision in order to prevent the introduction and spread of infectious and exotic animal diseases into the territory of the Republic of Kazakhstan from other states, the authorized body organizes veterinary control posts in accordance with the procedure determined by the authorized body.

     5. Vehicles entering the territory of the Republic of Kazakhstan from the border territory of neighboring states where an outbreak of particularly dangerous animal diseases has been registered are subject to mandatory disinfection for the period and in accordance with the procedure established by the legislation of the Republic of Kazakhstan in the field of veterinary medicine.

     6. State veterinary and sanitary inspectors at veterinary control posts, when performing their official duties, wear uniforms (without shoulder straps).

     The natural standards for providing state veterinary and sanitary inspectors at veterinary control posts with uniforms (without shoulder straps) are approved by the authorized body in coordination with the central authorized body for budget planning.

     Samples of uniforms (without shoulder straps) and the order of wearing are approved by the authorized body.

     7. Before concluding contracts for the export, import and transit of transported (transported) objects, an individual or legal entity has the right to receive information from the authorized body and its territorial divisions on the epizootic situation in the country of export, import and transit, on veterinary (veterinary and sanitary) rules excluding the import and export of pathogens of animal diseases. Confidential information should not be disclosed without the written consent of the owner of the object being moved (transported).  

     8. The procedure for state veterinary and sanitary control and supervision at veterinary control posts is carried out in accordance with the laws of the Republic of Kazakhstan, international treaties of the Republic of Kazakhstan and acts constituting the law of the Eurasian Economic Union.

     State veterinary and sanitary control and supervision at veterinary control posts are carried out in the form of documentary, physical and laboratory veterinary and sanitary control and supervision.

     9. Documentary control consists in checking documents confirming the safety of the objects being moved (transported); the availability of permits for the import (export) or transit of the objects being moved (transported); compliance with veterinary (veterinary and sanitary) requirements and rules, the absence of restrictions and prohibitions.

     Physical control includes inspection (inspection) of objects being moved (transported); verification of compliance of objects being moved (transported) with veterinary (veterinary and sanitary) requirements and rules, data specified in the submitted documents, including in order to exclude the presence of objects being moved (transported) that are not specified in the accompanying documents, and exclusion joint movement of incompatible movable (transported) objects; control of the vehicle's compliance with the established veterinary (veterinary and sanitary) requirements necessary for the transportation of objects being transported; control of the conditions and mode of movement (transportation); control of the conformity of packaging and labeling with the established requirements. Based on the results of the inspection, an appropriate act is drawn up.

     Laboratory control is carried out by conducting studies in cases of detection of visible organoleptic changes during inspection of objects being moved and exclusion of infectious animal diseases.

     Based on the results of these types of control, one of the following decisions is made regarding the objects being moved (transported): on admission (pass); on suspension of movement; on prohibition of import; on return.

     10. When importing a relocated (transported) object, including when importing from the member states of the Eurasian Economic Union, state veterinary and sanitary control and supervision are carried out at its final destination with a full inspection of the relocated (transported) object, including sampling and veterinary and sanitary examination.

This Law defines the legal, organizational and economic basis for carrying out activities in the field of veterinary medicine and is aimed at ensuring veterinary and sanitary safety.
