Article 76. Release from punishment and postponement of serving a sentence due to a combination of serious circumstances of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1. A person convicted of a criminal offense or a crime of minor and moderate gravity may be released from punishment by a court if circumstances have arisen that have entailed particularly grave consequences for his family as a result of a fire or natural disaster, serious illness or death of the only able-bodied family member or other extraordinary circumstances.
2. A person sentenced to imprisonment for a grave or especially grave crime, with the exception of persons convicted of a terrorist or extremist crime, or a crime committed as part of a criminal group or against the sexual integrity of minors, may, if there are grounds specified in part one of this article, postpone serving the sentence for up to three months.
The restriction on the postponement of serving a sentence does not apply to minors in the case of a crime committed against a minor between the ages of fourteen and eighteen.
