Comments on article 330. Consideration of the application for declaring a minor fully capable of the Civil Procedure Code of the Republic of Kazakhstan
An application for declaring a minor fully capable is considered by the court with the participation of the applicant, the parents (one of the parents), the adoptive parents (adoptive parent), the trustee, as well as a representative of the body performing the functions of guardianship or guardianship, the prosecutor.The commented article defines the circle of participants in the process of declaring a minor fully capable.The requirement for a circle of participants in cases of minor emancipation is primarily related to the need to ensure the rights and legitimate interests of the minor himself. Therefore, Article 330 of the CPC provides for the participation of his legal representatives, a representative of the guardianship authority, and a prosecutor in such cases. It follows from this that the court is obliged to make a decision on the application for emancipation, taking into account the opinions of all participants in the process.
