Article 36. The basic requirements for ensuring road safety in the design, construction, reconstruction, repair, maintenance and management of roads of the Law on Road Traffic
1. The design, construction, reconstruction, repair, maintenance and management of roads in the territory of the Republic of Kazakhstan must be carried out on the basis of and in compliance with the requirements of road safety established by this Law, technical regulations in the field of highways.
During the design, construction and reconstruction of roads, it is not allowed to reduce capital costs due to engineering solutions that negatively affect road safety.
2. Regulatory, design and technical documentation for the design, construction, repair, maintenance and management of roads in terms of ensuring road safety is subject to coordination and approval in accordance with the procedure established by the authorized body.
3. Responsibility for compliance of the road condition with the established requirements regarding road safety at the design stage is assigned to the customer and the contractor of the project, and at the stages of reconstruction and construction – to the customer and the contractor.
4. The obligation to ensure that the condition of roads during operation complies with the established requirements of this Law, rules, and technical regulations is imposed on individuals and legal entities that own (manage) roads.
5. Roads included in the international highway and Asian highway networks must comply with the requirements of international agreements.

This Law establishes the legal basis and general conditions for the functioning of road traffic and ensuring its safety in the Republic of Kazakhstan.
