Regulatory and legal framework for compensation for damage to the health or death of a citizen, including in connection with violations of traffic rules and accidents on transport
Relations on compensation for damage caused as a result of a traffic accident are primarily regulated by the Civil Code of the Republic of Kazakhstan, in particular Chapter 1 "The emergence of civil rights and obligations, the exercise and protection of civil rights", Chapter 47 "Obligations arising from harm", as well as Chapter 40 "Insurance". When considering emerging disputes, the following regulatory legal acts should also be followed:
- The Law of the Republic of Kazakhstan "On Road Traffic"; - The rules of the road approved by the Decree of the Government of the Republic of Kazakhstan dated November 25, 1997;
- The rules of the road approved by the decree of the Government of the Republic of Kazakhstan dated November 13, 2014;
- The Law of the Republic of Kazakhstan "On compulsory insurance of civil liability of owners of vehicles";
- The Law of the Republic of Kazakhstan "On Insurance Activities"; - Regulatory Resolution of the Supreme Court of the Republic of Kazakhstan No. 9 dated 07/09/1999 "On certain issues of application by courts of the Republic of Kazakhstan of legislation on compensation for damage caused to health";
- Regulatory Resolution of the Supreme Court of the Republic of Kazakhstan No. 3 dated 06/21/2001 "On the application by courts of legislation on compensation for moral damage".
The procedural procedure for the consideration and resolution of civil cases is stipulated by the Civil Procedure Code of the Republic of Kazakhstan.
