Article 45. The Audit Commission (auditor) The Law on Housing Relations

Article 45. The Audit Commission (auditor)  The Law on Housing Relations

 

     1. The owners of apartments and non-residential premises at the meeting have the right to elect an audit commission consisting of at least three persons or an auditor from among the owners of apartments and non-residential premises for a period of three years. 

     The members of the audit commission (auditor) may not perform other functions related to the management of the condominium facility. 

     Family members of the chairman of the association of property owners or members of the house council may not be elected as members of the audit commission (auditor). 

     2. The Audit Commission (auditor) reviews the financial documentation for the management of the condominium facility at least once a year in accordance with the rules for the management of the condominium facility. 

     The report of the audit commission (auditor) on the results of the audit of the financial documentation for the management of the condominium facility is considered at the meeting. 

     In the event of a change in the form of management of the condominium facility or the entity managing the condominium facility, the audit commission (auditor) reviews the financial documentation for the management of the condominium facility within one month. 

     3. The decision of the audit commission on issues within its competence shall be adopted by a simple majority of votes and signed by the members of the Audit Commission. 

     The auditor's decision is drawn up and signed by the auditor. 

     4. Owners of apartments, non-residential premises, parking spaces, storerooms, by decision of the meeting, have the right to audit the results of financial documentation on the management of the condominium facility. 

     In the event that the costs of audit services are paid at the expense of the personal funds of the owners of apartments, non-residential premises, parking spaces, storerooms, a resolution of the meeting is not required.
