Article 66. Property rights of a child of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan

    1. A child has the right to receive maintenance from his parents and other family members in accordance with the procedure and amounts established by section 5 of this Code.

     2. The amounts due to the child as alimony and allowances are placed at the disposal of the parents or other legal representatives of the child, with the exception of the heads of organizations for orphaned children and children left without parental care, and are spent by them on the maintenance, education and upbringing of the child.

     2-1. For the purpose of using alimony intended for the maintenance of children and excluding the possibility of foreclosure on them, a bank account is opened for crediting alimony in accordance with the procedure established by the banking legislation of the Republic of Kazakhstan.

     3. The child has the right of ownership to the income received by him, the property received by him as a gift or in the order of inheritance, as well as to any other property acquired with his funds.

     A child who earns income from his own work has the right to participate in the costs of maintaining the family if he lives with his parents.

     The right of a child to dispose of property belonging to him by right of ownership is determined by the Civil Code of the Republic of Kazakhstan.

     When parents exercise their powers to manage the child's property, they are subject to the rules established by Article 128 of this Code.

     4. A child and parents living together may own and use each other's property by mutual agreement.

     5. In the case of the right of common ownership of parents and a child, their rights to own, use and dispose of common property are determined by the Civil Code of the Republic of Kazakhstan.
