Article 471. Entry of the court's decision into legal force and its enforcement by the CPC of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan
1. A decision of the court of first instance shall enter into legal force and be enforced upon the expiration of the time limit for appealing or filing a motion by the prosecutor, or in the case of filing a private complaint or filing a motion by the prosecutor for consideration of the case by a higher court.
The court's decision on the issues specified in paragraphs 3) and 7) of Article 476 of this Code shall enter into legal force and be enforced immediately.
1-1. Court decisions on the release from punishment or postponement of serving the sentence of a convicted person, or the replacement of the unserved part of the sentence with a more lenient type of punishment due to illness, are subject to immediate execution in that part concerning the release of the convicted person from custody.
At the same time, these decisions may be appealed and reviewed at the request of the prosecutor on appeal in accordance with the rules established by Chapters 48 and 49 of this Code.
2. A court decision that is not subject to appeal, review at the request of the prosecutor, or appeal shall enter into force and be enforced immediately upon its issuance.
3. A court order to terminate a case, issued during a preliminary hearing or during the main trial, is subject to immediate execution in that part of it that concerns the release of the accused or defendant from custody.
4. The decision and verdict of the court of appeal shall enter into force from the moment of their announcement.
5. Sentences and decisions of the courts of appeal shall be enforced in accordance with the procedure provided for in Article 445 of this Code.
6. A private court decision, after no more than three days from the date of entry into force, is sent to the appropriate official performing managerial functions. No later than within one month, the necessary measures must be taken in accordance with a private decision and the results reported to the court that issued the decision.
