Article 79. Training and retraining of specialists, employees of hazardous production facilities and other organizations on industrial safety issues of the Law on Civil Protection
1. The heads of organizations operating hazardous production facilities are responsible for providing training and retraining of specialists and employees of hazardous production facilities on industrial safety issues.
The heads of these organizations are responsible for ensuring the training and retraining of specialists, employees of certified design organizations and other organizations involved in work at hazardous production facilities on industrial safety issues.
Training and retraining are carried out through training and subsequent knowledge testing (exams).

2. Training and knowledge testing (exams) of specialists, employees of hazardous production facilities, as well as certified design organizations and other organizations involved in work at hazardous production facilities, are carried out at the training center of a hazardous production facility or educational organization if they have a certificate granting the right to train, retrain specialists, workers in the field of industrial security.

3. Organizations certified for the right to train and retrain specialists and employees in the field of industrial safety, develop a curriculum and programs for training employees in industrial safety requirements, which are approved by their supervisor.

4. Technical managers, specialists and employees involved in the technological process of a hazardous production facility, operating, performing maintenance, technical inspection, installation and repair of hazardous production facilities, applying for work at hazardous production facilities, as well as certified design organizations and other organizations involved in work at hazardous production facilities are subject to training.:
1) workers performing work at hazardous production facilities – annually with a preliminary training program lasting at least ten hours.;
2) technical managers, specialists and engineering staff – once every three years with a preliminary training program lasting at least forty hours.
The persons specified in subparagraph 2) of part one of this paragraph may carry out training independently according to a standard program approved by the authorized body in the field of industrial safety.

5. Technical managers, specialists and employees involved in the technological process of a hazardous production facility, operating, performing maintenance, technical inspection, installation and repair of hazardous production facilities, as well as certified design organizations and other organizations involved in work at hazardous production facilities, with preliminary training according to a ten-hour program in the following cases are subject to retraining.:
1) when regulatory legal acts of the Republic of Kazakhstan in the field of civil protection establishing industrial safety requirements are put into effect, or when amendments and (or) additions are made to regulatory legal acts of the Republic of Kazakhstan in the field of civil protection establishing industrial safety requirements;
2) when being appointed to a position or transferred to another job, if the new responsibilities require additional security knowledge from the supervisor or specialist.;
3) in case of violation of industrial safety requirements;
4) during the commissioning of new equipment or the introduction of new technological processes;
5) at the request of the authorized body in the field of industrial safety or its territorial divisions, if they establish insufficient knowledge of industrial safety requirements.

6. The organization and conduct of knowledge checks (exams) for specialists, employees of hazardous production facilities, as well as certified design organizations and other organizations involved in work at hazardous production facilities, are provided by their managers in accordance with approved schedules. The persons subject to the knowledge test should be familiar with the schedule.

7. To test the knowledge of specialists, employees of organizations operating hazardous production facilities, as well as certified design organizations and other organizations involved in work at hazardous production facilities, permanent examination commissions are established by order (order) of the head of the organization operating hazardous production facilities or an educational organization, which are headed by the head or deputy head of the educational institution. the center of an organization that operates hazardous production facilities, or a training organization.
8. Heads of legal entities declaring industrial safety, as well as members of permanent examination commissions of these legal entities, take exams once every three years in accordance with the procedure established by the authorized body in the field of industrial safety.
8-1. The heads and members of permanent examination commissions of other legal entities take exams once every three years to the commission of an educational organization or training center of a hazardous production facility upon completion of the training course in compliance with the principle of independence.

9. It is not allowed to check knowledge by an examination board consisting of less than three people.
10. Exam tickets and/or electronic testing programs are developed by educational organizations and approved by their supervisors.

11. The results of the knowledge test are formalized by protocols. Knowledge verification protocols are saved until the next knowledge verification.
12. Persons who have passed the exams are issued certificates of a single standard, established by the authorized body in the field of industrial safety, signed by the chairman of the examination commission.
Certificates are issued to the heads of legal entities declaring industrial safety, as well as to members of permanent examination commissions of these legal entities.
13. The certificate is valid in the territory of the Republic of Kazakhstan for the period specified therein.
14. Persons who have not passed the exams are retested no later than one month.
15. Persons who have not passed the exam are not allowed to work.
16. Persons who have expired certificates must take the exam within one month after admission to work.
17. The costs of organizing training, including the remuneration of members of the examination committee, are borne by organizations operating hazardous production facilities, certified design organizations and other organizations involved in work at hazardous production facilities.
