On signing the Regulations on Salaries, Guarantees and Compensation of Officials of the Central Asia-China format Secretariat

Decree of the President of the Republic of Kazakhstan dated May 23, 2025 No. 890

 In accordance with subparagraph 1) of Article 8 of the Law of the Republic of Kazakhstan "On International Treaties of the Republic of Kazakhstan", I HEREBY DECREE:

     1. To approve the attached draft Regulations on Salaries, Guarantees and Compensations of Officials of the Central Asia-China format Secretariat.

     2. To sign on behalf of the Republic of Kazakhstan the Regulations on Salaries, Guarantees and Compensations of Officials of the Central Asia-China format Secretariat.

     3. This Decree shall enter into force from the date of its signing.

Provisions on salaries, guarantees and compensations of officials of the Central Asia-China format Secretariat

     The participating States of the Central Asia-China Format (hereinafter referred to as the Format) - the People's Republic of China, the Republic of Kazakhstan, the Kyrgyz Republic, the Republic of Tajikistan and the Republic of Uzbekistan, hereinafter referred to as the Participating States, have agreed on this Regulation defining the procedure and conditions of monetary maintenance, guarantees and compensations of officials of the Central Asia Format Secretariat. - China" (hereinafter referred to as the Secretariat).

     1. In this Regulation, Secretariat officials refer to nationals of the participating States who are employed within the approved staffing table in accordance with quotas and carry out their activities within the prescribed period.

     2. The work of the Secretariat officials is organized in accordance with the contracts concluded on the basis of these Regulations.

     3. Officials of the Secretariat shall be provided with monetary, material and household support in the following manner::

     a) a monthly salary (hereinafter referred to as the official salary) is paid in accordance with the standards provided for in Annex 1 to these Regulations, from the moment of commencement of official duties, but not earlier than the entry into force of the contract;

     b) the costs of renting (renting) residential premises are duly paid in the amounts established in accordance with appendix 2 to these Regulations, with the exception of communication services, Internet use, satellite and cable TV and similar expenses;

     c) an annual allowance is paid to Secretariat officials for the education of their children aged 3 to 18 years in the amount not exceeding 2,300 US dollars per child (no more than 3 children per official), upon submission of relevant documents;

     d) for a period of temporary incapacity for work not exceeding two months, the monetary allowance, as well as guarantees and compensations provided for in this Regulation, shall be maintained.;

     e) the annual leave is paid in the amount of the salary specified in subparagraph (a) of paragraph 3 of these Regulations, and the guarantees and compensations provided for in these Regulations are maintained for the duration of the annual paid leave.;

     f) in the event of the death of an official of the Secretariat, his family members shall be paid a one-time monetary allowance in the amount of 50% of the official salary of the Secretary-General from the Secretariat's budget and reimbursed for the costs associated with their relocation to their place of permanent residence in the territory of the sending State, in accordance with the procedure and on the terms stipulated by the contract, upon termination, in in accordance with sub-paragraphs (a)-(d) of paragraph 4 of these Regulations;

     g) in the event of the death of an official of the Secretariat or one of his family members staying with him in the People's Republic of China, the costs of paying for mandatory services related to the procedure for storing the body of the deceased, purchasing a coffin and transporting the body to its burial place in the territory of the sending State shall be paid;

     h) upon termination of the contract of an official of the Secretariat in connection with the liquidation, reorganization, reduction of the staff of the Secretariat or reduction of the established quota of officials, he shall be paid severance pay in the amount of two of his official salaries, as well as compensation for the departure of him and his family members to their place of permanent residence in the territory of the sending State in accordance with subparagraphs (a)-d) paragraph 4 of these Regulations;

     i) upon termination of the contract of an official of the Secretariat in connection with the expiration of the contract in the Secretariat, at the initiative of the official (for family reasons) He shall be compensated for the departure of him and his family members to a place of permanent residence in the territory of the sending State in accordance with subparagraphs (a)-(d) of paragraph 4 of these Regulations.;

     j) upon termination of the contract of an official of the Secretariat in connection with the termination of the contract with him due to non-performance or improper performance of his official duties, 50% of the lifting allowance received by him will be deducted from him and compensation will be paid to him for the departure of him and his family members to their place of permanent residence in the territory of the sending State in accordance with subparagraphs a)-d) paragraph 4 of these Regulations;

     k) upon termination of the contract of an official of the Secretariat in connection with the termination of the contract with him for non-performance or improper performance of his official duties due to entrepreneurial activity, 100% of the lifting allowance received by him will be deducted from him and the guarantees and compensations provided for in these Regulations will not apply to him and his family members.

     4. Officials of the Secretariat, including their family members (spouse, spouse and no more than three of their minor children or children over the age of 18 who became disabled before they reached the age of 18), who travel with them in connection with their initial assignment, are paid the following lump-sum compensation:

     a) the cost of travel by air and rail upon presentation of travel documents for:

     The Secretary General and his family members when traveling by air - at a business class fare, by rail - in the amount of the cost of a compartment or business class ticket.;

     Deputy Secretaries General and their family members when traveling by air - at a business class fare, by rail - in the amount of the cost of a compartment or business class ticket.;

     other officials of the Secretariat and their family members when traveling by air - at an economy class fare, by rail - in the amount of the cost of a reserved seat or second class ticket.;

     b) expenses for the payment of airport, insurance and compensation fees when traveling by the modes of transport specified in subitems a) and d) of paragraph 4 of these Regulations;

     c) the cost of transporting up to 80 kilograms of baggage per employee and his family members, but with a total volume of no more than 240 kilograms by air (or other means of transport within the cost of air transportation);

     d) in the case of family members (spouse, spouse and no more than three minor children or children over the age of 18 who became disabled before they reached the age of 18) separately from the official, compensation is paid for the following expenses: by air - at the economy class fare, by rail - in the amount of the cost of a reserved seat or second class ticket;

     e) officials of the Secretariat are paid a lifting allowance in the amount of two official salaries. In the case of an extension of an official's contract upon promotion or demotion after the expiration of the previous contract, the lifting allowance is not paid.

     5. Officials of the Secretariat shall be reimbursed for the costs of medical care, including maternity care (with the exception of elective surgeries, dental prosthetics and the manufacture and/or purchase of glasses and contact lenses), and/or medical insurance for him and the family members listed in paragraph 4 of these Regulations who are with him in the country of the Secretariat's residence, in the total amount not exceeding 1,200 US dollars per year, upon presentation of the relevant documents.

     6. Provision of any additional monetary allowance, other than the above-mentioned guarantees and compensations, to the Secretariat officials is not provided.

     7. The Ministry of Foreign Affairs of the People's Republic of China is the depositary of these Regulations.

     This Regulation shall enter into force on the date on which the depositary receives, through diplomatic channels, the last written notification from the participating States on their completion of the internal procedures necessary for its entry into force.

     The Depositary shall notify the Participating States and the Secretariat of the date of entry into force of this Regulation.

     After signature by all the participating States, the original copy of the Regulation shall be deposited with the depositary. The Depositary shall send certified copies of these Regulations to the participating States and the Secretariat.

     8. This Regulation may be amended and/or supplemented by agreement of the Participating States, which shall enter into force in accordance with the procedure provided for in paragraph 7 of this Regulation.

     9. Appendices 1 and 2 are an integral part of these Regulations.

     10. This Regulation shall expire on the date of termination of the Agreement on the Procedure for the Formation and Execution of the Budget of the Central Asia-China Format Secretariat.

     The Regulation is signed in one original copy in Chinese and Russian, both texts having the same validity.

APPENDIX 1 to the Regulations on Monetary Maintenance, Guarantees and Compensations of Officials of the Central Asia-China Format Secretariat

 

Staffing table and monthly salaries of the Secretariat officials

     1. The official salary of the Secretary General is 8,470 US dollars, assessed and reviewed every three years.

     2. The salaries of the remaining officials of the Secretariat are set in accordance with table 1 and are evaluated and reviewed every three years.

     3. The total number of full—time Secretariat officials is 16 people. The Chinese side undertakes to take 60% of the contributions, the Central Asian side (4 Central Asian states) - 40%, respectively, the Chinese side is provided with 10 staff quotas, and the Central Asian side - 6. Taking into account the proposals received from the Central Asian States, the Chinese side expressed its willingness to voluntarily cede to the Central Asian side the right to use two of its staff quotas, which results in 8 people from the Chinese side and 8 from the Central Asian side (each of the Central Asian states has 2 people).

APPENDIX 2 to the Regulations on Monetary Maintenance, Guarantees and Compensations of Officials of the Central Asia-China Format Secretariat

 

The amount and procedure for payment of monthly compensation for the costs of hiring (renting) residential premises for Secretariat officials

     1. Monthly compensation for the costs of renting (renting) residential premises for the Secretary-General is set at up to 2,200 US dollars, taking into account current rental prices for residential premises in the host country, and is assessed and reviewed every three years.

     2. The monthly compensation for the cost of hiring (renting) living quarters for the remaining Secretariat officials is set in accordance with table 2 and is evaluated and reviewed every three years.

     3. The costs of renting (renting) residential premises are compensated upon presentation of duly executed confirmations, with the exception of communication services, Internet use, satellite and cable TV and similar expenses.
