Article 241. Loss of biodiversity and compensation for loss of biodiversity of the Ecological Code of the Republic of Kazakhstan

1. Loss of biodiversity is recognized as the disappearance or significant reduction of populations of plant and (or) animal species in a certain area (in the water area) as a result of anthropogenic influences.

2. Compensation for the loss of biodiversity should be focused on a permanent and long-term increase in biodiversity and is carried out in the form of:

1) restoration of biodiversity lost as a result of activities carried out;

2) the introduction of the same or another type of biodiversity that is equally important for the environment in the same territory (in the water area) and (or) in another territory (in the water area) where such biodiversity is more important.

3. It is not allowed to implement the Document or the planned activity if:

1) this will lead to a loss of biodiversity in terms of plant and (or) animal world objects or their communities, which are rare or unique, and there is a risk of their destruction and inability to reproduce;

2) this will lead to the loss of biodiversity in terms of plant and (or) animal world objects or their communities, which are an integral part of a unique landscape, and there is a risk of its destruction and impossibility of restoration.;

3) this will lead to a loss of biodiversity and there are no sites with conditions suitable to compensate for the loss of biodiversity without deterioration of ecosystems;

4) this will lead to a loss of biodiversity and there are no technologies or methods to compensate for the loss of biodiversity;

5) this will lead to a loss of biodiversity of the animal world, with the exception of fish resources and other aquatic animals, and compensation for the loss of biodiversity is not possible for other reasons.

The procedure for compensating for the loss of biodiversity of fish resources and other aquatic animals is determined by the authorized body in the field of fisheries.

4. Measures to compensate for the loss of biodiversity are subject to mandatory implementation.

5. The procedure for compensating for the loss of biodiversity is determined by the authorized body for the protection, reproduction and use of wildlife.
