Article 96. Realization of the right to paid annual labor leave and payment of compensation upon termination of the employment contract of the Labor Code of the Republic of Kazakhstan
1. Paid annual work leave with subsequent termination of the employment contract due to the expiration of its term may be granted in the event that the vacation time is fully or partially beyond the term of the employment contract. The last day of the paid annual leave is considered to be the day of termination of the employment contract due to the expiration of its term.
2. Upon termination of the employment contract, an employee who has not used or has not used fully paid annual work leave (annual work leave) is compensated for unused days of paid annual work leave (annual work leave).
The compensation payment for unused days of paid annual labor leave (annual labor vacations) is calculated based on the average salary of the employee.
