Article 1. The basic concepts used in this Law Chapter 1. General provisions of the Law on Mass Media

      The following concepts are used in this Law:  

     1) accreditation is a procedure for the appointment of a journalist and the recognition of his authority by a state body, a public association and an organization.;

     2) the editor-in-chief (editor) is an individual who heads the editorial office of a mass media outlet and has the appropriate authority to publish and distribute it, to go on the air.;

     3) mass information - printed, audiovisual and other messages and materials intended for an unlimited number of people;

     4) mass media - a periodical print publication, television, radio channel, documentary films, audiovisual recordings and other forms of periodic or continuous public dissemination of mass information, including online resources;

     5) mass media products - the circulation or part of the circulation of a separate issue of a periodical or an audiovisual program, a separate issue of a radio, television, newsreel program, information posted on an Internet resource;

     5-1) media monitoring – the process of collecting and analyzing media products for compliance with the legislation of the Republic of Kazakhstan;

     6) authorized body in the field of mass media - a state body that carries out state regulation in the field of mass media (hereinafter referred to as the authorized body);

     7) distribution of mass media products - sale (subscription, delivery, distribution) of periodicals, broadcasting of radio and television programs, demonstration of newsreel programs and posting information on Internet resources;

     8) editorial office of a mass media outlet - an individual or a creative team that is a structural subdivision of a legal entity that collects, prepares materials and publishes mass media;

     8-1) online publication – an online resource that has been registered with an authorized body, the information and communication infrastructure of which is located on the territory of the Republic of Kazakhstan;

     9) a journalist (a representative of the mass media) is an individual who carries out activities related to the collection, processing and preparation of messages and materials for the mass media on the basis of employment or other contractual relations.;

     10) complex - a set of buildings connected by a common purpose and forming a single structure;

     10-1) Foundation is a structural subdivision of a legal entity under the jurisdiction of an authorized body that implements projects aimed at supporting the media and promoting the growth of professionalism of Kazakhstani journalists (hereinafter referred to as the Foundation);

     10-2) state order for the implementation of state information policy – an order for the provision of services at the expense of the republican and local budgets for the implementation of state information policy;

     11) periodical print edition - newspaper, magazine, almanac, bulletin, appendices to them, having a permanent name, current issue and issued at least once every three months;

     12) film and video products of a pornographic and special sexually erotic nature - naturalistic, detailed fixation of sexual intercourse or demonstration of naked genitals during sexual contact, contributing to the arousal of sexual desire or satisfaction of sexual needs that do not correspond to moral values, offend human honor and dignity;

     13) official communication – information provided and (or) disseminated through the mass media by the information holder established in accordance with the Law of the Republic of Kazakhstan "On Access to Information";

     13-1) stationary premises - capital buildings, structures or part thereof, having a foundation, the movement of which is impossible without causing damage to their supporting structure;

     14) information promoting suicide is information that encourages the deliberate taking of a person's own life.;

     15) distributor - a natural or legal person who distributes mass media products under an agreement with its owner, publisher or on other legal grounds;

     16) television and radio channel - a mass media, which is a set of television, radio programs and audiovisual works, plots and materials formed in accordance with the broadcast schedule for subsequent broadcast and/or retransmission;

     17) a television, radio, newsreel program is a meaningfully completed part of a television or radio channel, which has the appropriate name, broadcasting volume and can be used independently of other parts of the television or radio channel.;

     18) censorship is the preliminary coordination of messages and materials by the mass media with government agencies, officials and other organizations at their request or on other grounds in order to restrict or prohibit the dissemination of messages and materials or their individual parts.;

     19) on-air broadcasting - broadcasting of television, radio programs, audiovisual recordings using analog and digital electromagnetic systems;

     20) erotic products are printed publications or television or radio programs that demonstrate sexual relations between people, intimate parts of the human body, with the exception of genitals, and do not contain elements of pornography.

 

 

The Law of the Republic of Kazakhstan dated July 23, 1999 No. 451-I.

      This Law regulates public relations in the field of mass media, establishes state guarantees of their freedom in accordance with the Constitution of the Republic of Kazakhstan.
