Article 5. The right to create a mass media Chapter 2. Organization of mass media activities of the Law on Mass Media
1. The right to create a mass media belongs to individuals and legal entities in accordance with the legislation of the Republic of Kazakhstan.
A mass media outlet can be created either in the form of a legal entity or in the form of a structural subdivision of a legal entity.
The basis for the release (airing) of mass media products, the dissemination of messages and materials of an informational nature is a certificate of registration of a television, radio channel, a periodical, an information agency and (or) an online publication.
These requirements do not apply to online resources.
2. It is prohibited for foreigners and foreign legal entities, stateless persons to directly and (or) indirectly own, use, dispose of and (or) manage more than 20 percent of shares (stakes, units) of a legal entity that owns mass media in the Republic of Kazakhstan or carries out activities in this field.
The provision of the first part of this paragraph does not apply to Internet resources intended for electronic commerce.
The Law of the Republic of Kazakhstan dated July 23, 1999 No. 451-I.
This Law regulates public relations in the field of mass media, establishes state guarantees of their freedom in accordance with the Constitution of the Republic of Kazakhstan.
