Article 12. The grounds for the emergence of the right of ownership of housing Law on Housing Relations
Ownership of a dwelling or part of it arises on the following grounds:
1) building a house (part of a house);
2) making transactions of purchase and sale, exchange, donation, alienation with the condition of lifelong maintenance and other civil law transactions that do not contradict the legislation of the Republic of Kazakhstan;
3) obtaining a home by inheritance or by way of universal succession;
4) the acquisition by the tenant of a dwelling occupied by him or a dwelling (apartment) from the state housing stock through its privatization (purchase or gratuitous transfer);
5) acceptance by a member of a housing and construction cooperative of an apartment under a transfer act in accordance with a contract of participation in a housing and construction cooperative in an apartment building put into operation.;
6) the provision of residential premises for ownership by virtue of a contractual obligation, including an agreement on the participation of a citizen with his own funds or labor in the construction of a house;
7) provision of housing by legal entities based on a non-governmental form of ownership to their employee or another person through sale or gratuitous transfer;
8) provision of housing by the state or a legal entity based on the state form of ownership to its employee or another person on the terms established by the legislation of the Republic of Kazakhstan;
9) provision of housing as compensation for the loss of a privately owned dwelling due to demolition or requisition, or in the event that the dwelling became uninhabitable as a result of environmental disasters, natural and man-made emergencies in the territory of the Republic of Kazakhstan;
10) on other grounds not prohibited by legislative acts of the Republic of Kazakhstan.
