Article 217. Transfer of ownership of a ship or a ship under construction or change of state registration The Merchant Shipping Act
1. If the claims secured by the registered mortgage of a vessel or a vessel under construction are not satisfied, or there is no written consent of all the mortgagees, the seaport administration has no right to exclude the vessel from the State Register of Ships or the Ship Book, or to amend the entry on the state registration of ownership of the vessel under construction in the register of ships under construction, except in the following cases: provided for in Articles 219 and 220 of this Law.
2. In cases where the exclusion of a vessel from the State Register of Ships or the Ship's Register, or the ownership of a vessel under construction from the register of ships under construction is mandatory (except in cases of voluntary sale), the state registration authority must notify the mortgagees of the impending exclusion of the vessel or ownership of the vessel under construction from the relevant registers, so that the mortgagees take appropriate measures. to protect their interests. If their consent is not obtained, the vessel or the ownership of the vessel under construction is excluded from the relevant registers after a reasonable period, but not less than three months after the notification of the mortgagees.
