Article 28. Termination of the right of ownership of a dwelling Chapter 5. Termination of the right of private ownership of housing under the Housing Relations Act

      1. The right of ownership to a dwelling is terminated when the owner of the dwelling is alienated to another person, in the event of the death of the owner or in the event of destruction of the dwelling, as well as in other cases provided for by the Civil Code of the Republic of Kazakhstan.  

     2. When one of the participants in the common shared ownership of a dwelling sells its share, the other participant in the common shared ownership has the pre-emptive right to purchase.  

     If several participants in common shared ownership apply for the acquisition of the share being sold, the seller has the right to choose the buyer. The procedure for exercising the right of pre-emptive purchase of a share in common ownership of a dwelling is determined by the Civil Code of the Republic of Kazakhstan.
