Article 198. Decisions taken during the pre-trial investigation of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. In the course of a pre-trial investigation, when a procedural decision is made in accordance with this Code by the person conducting the pre-trial investigation, a resolution is issued indicating the place and time of its preparation, the name and position of this person, the substance and grounds of the decision, the articles of this Code on the basis of which the decision was made, except for the cases, when this Code explicitly provides for the possibility of a given person making a decision without making a separate ruling, with the decision reflected in the protocol of the procedural action.
2. Decisions made by the head of the body of inquiry, the head of the investigative department, the prosecutor, or the investigating judge may be formalized by resolution, except in cases where the provisions of this Code explicitly provide for the need for these persons to make a decision.
