Article 302. The decision and actions of the prosecutor in a criminal case filed with an indictment or a report on the completion of a pre-trial investigation CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. Based on the results of studying the materials of the criminal case, the prosecutor performs one of the following actions::
1) in cases received with a report on the completion of the pre-trial investigation, draw up an indictment, and in cases received with an indictment, approve it;
3) directs the criminal case to the person conducting the pre-trial investigation for additional investigation;
3-1) in case of failure or improper conduct of a parallel financial investigation, directs the criminal case to the person conducting the pre-trial investigation for additional investigation.;
IZPI's note! Part 1 is provided to be supplemented by paragraph 3-1) in accordance with the Law of the Republic of Kazakhstan dated 07/16/2025 No. 210-VIII (effective from 01/01/2027).
4) terminates the criminal case in full or in part on the grounds provided for in Articles 35 and 36 of this Code.;
5) at its discretion or at the request of the defense, decides on the conclusion of a procedural agreement.;
6) supplements or reduces the list of persons to be summoned to court, with the exception of the list of defense witnesses.
2. The prosecutor shall carry out the actions provided for in the first part of this article within ten days, and in complex, multi-episode criminal cases these actions may be carried out within up to one month.
2-1) in case of disagreement with the indictment drawn up by the person conducting the pre-trial investigation, resubmit the indictment.;
