Article 28. Acquisition of property rights in case of compulsory alienation of property for State needs of the Law on State Property

     1. Acquisition by the state (the Republic of Kazakhstan or an administrative-territorial unit) of property rights in the event of compulsory alienation of property for state needs is carried out in accordance with the procedure and on the terms established by this Law and other laws of the Republic of Kazakhstan.

     2. Acquisition of property in case of compulsory alienation of property for state needs is carried out at the expense of budgetary funds or other state property in accordance with this Law and other laws of the Republic of Kazakhstan.

     3. The property acquired by the State during the compulsory alienation of property for state needs goes to the state or local treasury.

         This Law defines the legal regime of state property, the legal basis for the management of State property, including property assigned to State-owned legal entities, and state-owned shares and stakes in the authorized capital of legal entities, the legal grounds for the acquisition and termination of rights to state property, and is aimed at ensuring the effective exercise by the State of the rights of the owner and holder of other rights. on state property.
