Article 88. Compulsory alienation of a land plot for state needs by a court decision of the Land Code of the Republic of Kazakhstan

1. If the owner or a non-governmental land user does not agree with the decision on the commencement of compulsory alienation of the land plot for state needs or an agreement has not been reached with him on the terms of the contract on the alienation of the land plot for state needs, the local executive body has the right to apply to the court with a claim for compulsory alienation of the land plot for state needs.
2. A claim for the compulsory alienation of a land plot for state needs may be filed after three months from the date of receipt by the owner of the land plot or a non-governmental land user of a notification of the compulsory alienation of the land plot for state needs, but not later than the deadline (date) for the compulsory alienation for state needs specified in the resolution on the commencement of the compulsory alienation of the land plot for state needs. needs.
3. Civil cases on claims for the compulsory alienation of a land plot for state needs are considered and resolved within one month from the date of completion of the preparation of the case for trial.
