Article 66. The rights of the owner or non-state land user in the case of compulsory alienation of a land plot or other immovable property in connection with the seizure of a land plot for state needs of the Law on State Property
1. From the moment of receiving a notification of the compulsory alienation of a land plot for state needs until the conclusion of an agreement on the alienation of a land plot or a court decision on the compulsory alienation of a land plot or other immovable property in connection with the seizure of a land plot for state needs, the owner or non-governmental land user may exercise the right to a land plot and other real estate belonging to him and produce necessary expenses to ensure the use of this property in accordance with its intended purpose. At the same time, the owner or a non-governmental land user bears the risk of attributing to him the costs and losses associated with new construction, expansion or reconstruction of buildings (structures, structures) and other real estate objects during the specified period.
If the owner or a non-governmental land user, after alienating a part of the land plot for state needs, cannot use the remaining part for its former intended purpose, the entire land plot is alienated.
2. In case of transfer of rights to real estate during the time specified in paragraph 1 of this Article to another person by alienation or on other grounds, as well as in case of change of the rightholder by virtue of universal succession, the procedure for compulsory alienation of land or other immovable property in connection with the seizure of land for state needs shall be applied (continued) in respect of the new the copyright holder.
