Article 62-2. Conditions for the provision of an equivalent land plot or immovable property in connection with the seizure of a land plot for State needs of the Law on State Property
1. The provision of an equivalent land plot to the owner or a non-governmental land user is carried out taking into account the location of the alienated land plot, its intended purpose, and the area with compensation for damages (if any).
In this case, an equivalent land plot must be provided within the locality in which the land plot is being alienated. The location of such a land plot within a locality is determined in a draft agreement on the alienation of a land plot for state needs, sent in accordance with Article 64 of this Law.
2. When a residential building is demolished due to the seizure of a land plot for state needs, other immovable property is provided in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Housing Relations".
3. The provision of an equivalent land plot to an owner or a non-governmental land user is carried out in accordance with the procedure established by Article 43 (with the exception of the requirements of the sub-paragraphs 1), 2), 3), 4) and 5) paragraph 1) of the Land Code of the Republic of Kazakhstan.
At the same time, the costs of land management work when providing an equivalent land plot to an owner or a non-governmental land user are financed from budgetary funds.
4. The price of a state-owned land plot provided in exchange shall be determined by an appraiser at its market value after an assessment of the alienated land plot or other immovable property in connection with the seizure of the land plot for state needs.
5. If the value of the alienated land plot turns out to be higher than the value of the land plot provided in return, the difference in their value is reimbursed to the owner.
