Article 68. Forms of payment and terms of payment of compensation in case of compulsory alienation of a land plot or other immovable property in connection with the seizure of a land plot for state needs of the Law on State Property

Article 68. Forms of payment and terms of payment of compensation in case of compulsory alienation of a land plot or other immovable property in connection with the seizure of a land plot for state needs of the Law on State Property

     1. The cost of a land plot or other immovable property in connection with the seizure of a land plot for state needs and losses subject to compensation is reimbursed in full until the transfer of ownership rights to the specified property to the Republic of Kazakhstan or an administrative-territorial unit.

     2. Compensation is paid from budgetary funds.

     3. Payment of compensation with property other than money is allowed by agreement between the Republic of Kazakhstan represented by the Government of the Republic of Kazakhstan or an administrative-territorial unit represented by a local executive body and the owner of the property. The said agreement is drawn up in the written form of an agreement on the alienation of a land plot for state needs.

     4. Compensation is paid in a lump sum no later than one month from the date of signing the agreement on the alienation of the land plot for state needs or from the date of entry into force of the court decision.

     5. The compulsory alienation of a land plot or other immovable property in connection with the seizure of a land plot for state needs, which provides for the payment of compensation in installments, is not allowed.

         This Law defines the legal regime of state property, the legal basis for the management of State property, including property assigned to State-owned legal entities, and state-owned shares and stakes in the authorized capital of legal entities, the legal grounds for the acquisition and termination of rights to state property, and is aimed at ensuring the effective exercise by the State of the rights of the owner and holder of other rights. on state property.
