Article 591. Decision on the request for the extradition of a person (extradition) CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. After studying the materials of the extradition check, the Prosecutor General of the Republic of Kazakhstan or his deputy decides on the extradition of a person (extradition) or refusal to extradite (extradition) to a foreign state. If there are demands from several States for the extradition of a person, the decision on which State the person is to be extradited is made by the Prosecutor General of the Republic of Kazakhstan or his deputy in the form of a resolution.

     2. The Prosecutor General of the Republic of Kazakhstan or his deputy notifies the central authority of a foreign state, as well as the person against whom it was made, and his defender of his decision.

     3. In case of a decision on extradition, this person is given a copy of the decision and the right to appeal the decision to the Supreme Court of the Republic of Kazakhstan is explained.

     4. A decision on the extradition of a person shall be enforced upon the expiration of the time limit for its appeal. In case of appeal against the decision, the extradition of the person (extradition) is not carried out until the entry into force of the decision of the judge of the Supreme Court of the Republic of Kazakhstan.

     The participation of the person in respect of whom the decision on extradition (extradition) has been taken and his lawyer can be ensured through technical means of videoconferencing.

     5. In case of refusal to extradite a person to a foreign state on grounds that do not exclude criminal prosecution, the Prosecutor General of the Republic of Kazakhstan shall entrust the conduct of a pre-trial investigation against this person in accordance with the procedure provided for by this Code at the request of the competent authority of the foreign state.
