Article 75. Summary accounting of working hours of the Labor Code of the Republic of Kazakhstan
1. Cumulative accounting of working hours is used in continuously operating industries, workshops, sites and in certain types of work where, due to the conditions of production (work), the daily or weekly working hours established for this category of employees cannot be observed.
2. The accounting period for the cumulative accounting of working hours is the period within which the average daily and (or) weekly working hours established for this category of employees must be observed.
For employees who work part-time (shift) and/or part-time, or when applying for joint employment, the normal number of working hours during the accounting period decreases accordingly.
3. The accounting period for the cumulative accounting of working hours may be any calendar period, but not more than one year or the period of performance of a certain work.
4. When establishing cumulative accounting of working hours, it is mandatory to observe the duration of the employee's rest between the end of work and its start on the next working day (work shift).
5. The working procedure for cumulative accounting of working hours, the categories of employees for whom cumulative accounting of working hours is established, are determined by a collective agreement or an act of the employer.
6. It is not allowed to involve employees under the age of eighteen in work using cumulative time tracking.
7. The use of cumulative working time accounting for pregnant women is not allowed if the working day (work shift) will exceed eight hours.
8. The use of cumulative time accounting for employees with disabilities of the first group is not allowed.
Cumulative accounting of working hours for employees with disabilities of the second and third groups cannot be established if such a regime is prohibited to them on the basis of the conclusion of the expert occupational pathology commission.
9. Upon termination of the employment contract before the end of the accounting period, the employee has the right to pay overtime hours on the same terms for the time worked from the beginning of the accounting period to the day of termination of the employment contract.
