Article 85. Rules of the bidding organizer The Law on the Securities Market
1. The rules of the bidding organizer are developed by its executive body and approved by the board of directors of the bidding organizer.
Compliance with the rules of the bidding organizer is mandatory for all entities using the services of the bidding organizer.
2. Excluded by the Law of the Republic of Kazakhstan dated 05/16/2014 No. 203-V (effective six months after the date of its first official publication).
3. The rules of the bidding organizer regulate the activities of the members of the bidding organizer when making transactions with financial instruments admitted to circulation in the trading system of the stock exchange, as well as the relations arising between the bidding organizer, its members, clients and other persons using the services of the bidding organizer.
4. The rules of the bidding organizer include the internal documents of the bidding organizer regulating the issues included in the functions of the bidding organizer.
5. The rules of the stock exchange should determine:
1) categories of membership on the stock exchange, conditions and procedure for joining the stock exchange, rights and obligations of members of the stock exchange, conditions and procedure for suspension and termination of membership on the stock exchange;
2) requirements for traders participating on behalf of a member of the stock exchange in trading in securities and other financial instruments traded in the trading system of the stock exchange, as well as performing other actions using the trading system of this stock exchange;
3) excluded by the Law of the Republic of Kazakhstan dated 07/02/2018 No. 166-VI (effective ten calendar days after the date of its first official publication); 4) Excluded by the Law of the Republic of Kazakhstan dated 07/12/2022 No. 138-VII (effective sixty calendar days after the date of its first official publication).
5) requirements for issuers whose securities are expected to be included or included in the list of the stock exchange, as well as for such securities;
6) conditions and requirements for the inclusion of securities in the list of the stock exchange, their exclusion from this list and the change of the category of the list;
6-1) conditions and requirements for the admission of financial instruments that are not securities to circulation on the stock exchange;
7) duties and responsibilities of issuers whose securities are included in the official list of the stock exchange (including disclosure of information);
8) the list, terms and requirements for information to be disclosed by the initiator of admission of securities included in the official list of the stock exchange;
9) conditions and methods of conducting exchange trading in securities;
9-1) a method of ensuring the fulfillment of obligations under transactions with financial instruments carried out in the stock exchange trading system;
10) the procedure for making settlements on transactions with financial instruments concluded at exchange auctions;
11) conditions and procedure for suspension and resumption of trading on the stock exchange;
12) the methodology for evaluating financial instruments admitted to circulation in the stock exchange trading system;
13) liability of members of the stock exchange and traders of the stock exchange for violating the rules of stock trading, the amount and procedure for payment of fines levied by the stock exchange;
14) the procedure for resolving disputes and conflicts arising in the course of transactions with financial instruments;

16) the procedure of the listing commission;
17) excluded by the Law of the Republic of Kazakhstan dated 07/02/2018 No. 166-VI (effective from 01.01.2019);
18) rules for the identification and prevention of cases of misuse of insider information, manipulation in the securities market;

6. The organizer of the auction, within ten working days from the date of adoption of the rules or making amendments and (or) additions to them, notifies the authorized body about this with the attachment of these documents.
6-1. The internal documents of the organizer of the auction, with the exception of those specified in paragraph 5 of this article, are developed and approved by the executive body of the organizer of the auction.
7. The requirements of this article do not apply to the central securities depository.

This Law regulates public relations arising in the process of issuance, placement, circulation and repayment of equity securities and other financial instruments, the specifics of the creation and operation of securities market entities, defines the procedure for regulation, control and supervision of the securities market in order to ensure the safe, open and effective functioning of the securities market, protection of investors' rights. and holders of securities, fair competition of securities market participants.
