Article 95. Confiscation of the Land Code of the Republic of Kazakhstan

     In cases stipulated by the legislative acts of the Republic of Kazakhstan, a land plot may be seized free of charge from the owner or land user in court as a sanction for committing an administrative or criminal offense.

     The land plots necessary for the convicted person and persons dependent on him, belonging to the convicted person on the right of private ownership or being his share in common ownership, on which the house and outbuildings are located, as well as land plots necessary for maintaining personal subsidiary farming, according to the list provided for by the penal enforcement legislation of the Republic, are not subject to confiscation. Kazakhstan.  

     The confiscated land plots are returned to State ownership. The sale or further use of such land plots or the right of land use, which is the object of confiscation, may be carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
