Article 91. Temporary seizure of a land plot in emergency situations of the Land Code of the Republic of Kazakhstan

Article 91. Temporary seizure of a land plot in emergency situations of the Land Code of the Republic of Kazakhstan

     1. In the event of natural disasters, martial law, accidents, epidemics, epizootics and other emergency situations, a land plot in the public interest may be temporarily withdrawn from the owner or land user with compensation for losses by decision of local executive bodies. The assessment according to which the owner or land user is compensated for losses may be challenged in court.  

     2. Upon termination of the emergency, the land plot is subject to return to the owner (land user), and if there is a dispute, he has the right to demand its return in court.  

     3. If it is impossible to return the land plot to the owner or land user, the cost of the land plot or land use rights is reimbursed.  

     4. The procedure for the requisition of property, including immovable property, in case of temporary seizure of a land plot is carried out in accordance with the norms of the civil legislation of the Republic of Kazakhstan.
