Article 103. Recognition of the adoption as invalid of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan

Article 103. Recognition of the adoption as invalid of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan

1. An adoption is recognized as invalid in the following cases::

     1) adoption of a court decision on adoption based on forged documents;

     2) adoption without the consent of the persons specified in Article 93 of this Code;

     3) adoption by a married person without the written consent of the other spouse;

     4) violations of the provisions provided for in paragraph 2 and part two of paragraph 3 of Article 91 of this Code.

     2. The recognition of an adoption as invalid is carried out in court.

     3. The case of recognition of an adoption as invalid is considered by the court with the obligatory participation of the adoptive parents, the prosecutor and a representative of the body performing the functions of guardianship or trusteeship.
