Article 87. The procedure for the adoption of a child of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. Adoption is carried out by the court at the request of the persons (persons) wishing to adopt the child. Cases of child adoption are considered by the court in accordance with the procedure of special proceedings provided for by the Civil Procedure Code of the Republic of Kazakhstan.
Cases of adoption of children are considered by the court with the obligatory participation of the adoptive parents themselves, a representative of the body performing the functions of guardianship or guardianship, as well as the prosecutor.
2. When adopting a child who is a foreigner on the territory of the Republic of Kazakhstan by citizens of the Republic of Kazakhstan, it is necessary to obtain the consent of the child's legal representative and the competent authority of the State of which the child is a citizen, as well as, if required by the legislation of the said State, the child's consent to adoption.
3. The adoption of a child who is a citizen of the Republic of Kazakhstan and resides outside the Republic of Kazakhstan, carried out by the competent authority of the foreign state of which the adoptive parent is a citizen, is recognized as valid in the Republic of Kazakhstan provided that a preliminary adoption permit is obtained from the local executive body at his place of residence or his parents before leaving the territory of the Republic of Kazakhstan.
4. The adoption on the territory of the Republic of Kazakhstan by foreigners married to citizens of the Republic of Kazakhstan of a child who is a citizen of the Republic of Kazakhstan is carried out in accordance with the procedure established by this Code for foreigners.
