Article 106. Intentional infliction of serious harm to health of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1 Intentional infliction of serious harm to health –
is punishable by restriction of liberty for a term of three to eight years or imprisonment for the same term.
2 The same act committed by:
1) in relation to two or more persons;
2) in relation to a person or his relatives in connection with the exercise of official activity by this person or the performance of a professional or public duty;
3) in relation to a person who is obviously helpless for the perpetrator, or who is financially or otherwise dependent on the perpetrator, as well as involving kidnapping or hostage-taking;
4) with extreme cruelty;
5) a group of persons, a group of persons by prior agreement;
6) for selfish reasons, as well as for hire;
7) out of hooligan motives;
8) motivated by social, national, racial, religious hatred or enmity;
9) for the purpose of using the victim's organs or tissues;
10) repeatedly;
11) in relation to a known minor,
12) in an emergency situation or during mass riots, –
is punishable by imprisonment for a term of six to ten years with or without confiscation of property.
3 The acts provided for in the first or second parts of this Article that negligently caused the death of the victim or were committed by a criminal group, –
are punishable by imprisonment for a term of eight to twelve years with or without confiscation of property.
