Article 197. Monitoring the activities of market entities occupying a dominant or monopolistic position in regulated markets of the Entrepreneurial Code of the Republic of Kazakhstan
1. The objectives of monitoring the activities of market entities occupying a dominant or monopolistic position in regulated markets are to identify and suppress violations related to the abuse of a dominant or monopolistic position, with the exception of violations provided for by the legislation of the Republic of Kazakhstan on natural monopolies and regulated markets.
2. Market entities included in the state register of market entities occupying a dominant or monopolistic position in regulated markets are required to submit to the antimonopoly authority:
1) audited financial statements for market entities subject to mandatory annual audit in accordance with the legislation of the Republic of Kazakhstan on auditing activities based on the results of the year – by August 31 of the following year;
2) quarterly information on the sale or transfer to trust management of ten or more percent of its voting shares (shares in the authorized capital, units) – by the fifteenth day following the reporting period.;
3) quarterly information on monopoly products on the volume of production and sales, selling prices and the level of profitability of sold monopoly goods in a form determined by the antimonopoly authority – by the fifteenth day following the reporting date.
