Article 203. Monitoring of compliance with the standards of permissible emissions of the Environmental Code of the Republic of Kazakhstan
1. Monitoring of compliance with the standards of permissible emissions from a stationary source and (or) a combination of stationary sources and their impact on atmospheric air quality is carried out in accordance with the requirements of this Code and the conditions established in the environmental permit.
2. Monitoring of compliance with the standards of permissible emissions from a stationary source and (or) a set of stationary sources is carried out by measurements in accordance with the approved list of measurements related to state regulation. If it is impossible to carry out monitoring by measurements, the use of a calculation method is allowed.
In the cases provided for by this Code, monitoring of compliance with permissible emission standards at Category I facilities is also ensured through the mandatory use of an automated system for monitoring emissions into the environment.
3. Monitoring of compliance with environmental standards of atmospheric air quality is carried out at the assessment points established in the environmental permit.
4. The location of the assessment points within the impact area is determined in such a way that:
1) they achieved the maximum values of the impact of emissions, established based on the results of modeling surface concentrations of pollutants and taking into account the corresponding averaging period for each pollutant;
2) the existing natural and anthropogenic backgrounds of atmospheric air were taken into account.
5. The number of assessment points depends on the established averaging period for a particular pollutant and is determined as follows:
1) the level of compliance with environmental standards of atmospheric air quality for pollutants, for which both daily (short-term maximum exposure) and annual (long-term exposure) values are determined, is estimated at two corresponding points;
2) the level of compliance with environmental standards of atmospheric air quality for pollutants having only annual value is estimated at one assessment point.
6. Additional assessment points are determined for pollutants for which environmental standards of atmospheric air quality are established in terms of their impact on ecosystems and vegetation. The assessment points for compliance with such environmental standards should be set at a distance of at least twenty kilometers from agglomerations and at least five kilometers from other urban areas and industrial zones.
7. If residential areas are located within the impact area, additional assessment points should be established.
8. The justification for determining the location and number of assessment points should be provided in the environmental permit.
