Article 280. Environmental monitoring of the State protected area in the northern part of the Caspian Sea Environmental Code of the Republic of Kazakhstan

Article 280. Environmental monitoring of the State protected area in the northern part of the Caspian Sea Environmental Code of the Republic of Kazakhstan

     1. State environmental monitoring is mandatory in the state protected area in the northern part of the Caspian Sea by the authorized body in the field of environmental protection.

     2. A subsurface user conducting subsurface use operations in the state protected area in the northern part of the Caspian Sea is required to conduct annual industrial environmental monitoring (according to climatic seasons) throughout the contract territory, with the exception of monitoring in winter in the sea area covered with ice, in order to prevent negative impacts on the marine environment.

     3. Environmental impact assessment materials for each stage of hydrocarbon exploration and (or) production operations (geophysical surveys, engineering and geological surveys, drilling, construction, development, operation, liquidation, etc.) should provide for industrial monitoring, which includes:

     1) field studies of the state of the environment at production facilities at each stage of operations for the exploration and (or) production of hydrocarbons;

     2) monitoring of pollution sources;

     3) Environmental monitoring;

     4) monitoring the consequences of accidental environmental pollution.

     4. State environmental and industrial environmental monitoring should include monitoring of the following parameters:

     1) the level of pollution of waters, as well as bottom sediments according to physical, chemical and hydrobiological indicators in different status (regime) areas of the Caspian Sea;

     2) the balance and transformation of pollutants in certain areas of the Caspian Sea (at sampling control points in the open sea, bays, estuarine areas, rivers flowing into the sea, areas of operations for exploration and (or) production of hydrocarbons), at the atmosphere–water interface and their accumulation in bottom sediments (precipitation);

     3) natural circulation processes, hydrometeorological indicators (water temperature, currents, wind speed and direction, precipitation, atmospheric pressure, air humidity).

     5. If necessary and at the request of the authorized body in the field of environmental protection, the subsurface user must conduct additional studies of the state of the environment.

     6. The subsurface user determines the types and methods of monitoring the state of the environment in accordance with the procedure established by the authorized body in the field of environmental protection.

     7. When conducting production monitoring, the subsurface user must take into account the results of observations from previous years and use the readings of existing stations located on the work area (within the contract territory and in its surroundings) in order to continue a long-term series of observations.

     8. In case of emergency situations, monitoring of the consequences of accidental environmental pollution should be organized without delay.

     9. The subsurface user is obliged to transfer the results of production monitoring to the authorized body in the field of environmental protection.
