Article 404. Creation, management and participation in the activities of illegal public and other associations of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1 The creation or leadership of a religious or public association whose activities involve violence against citizens or other harm to their health, or encouraging citizens to refuse to perform civil duties or commit other illegal acts, as well as the creation or leadership of a religious-based party, political party or trade union, funded from prohibited by law Republic of Kazakhstan sources, –
are punishable by a fine in the amount of up to six thousand monthly calculation indices, or correctional labor in the same amount, or restriction of liberty for up to six years, or imprisonment for the same term, with deprivation of the right to hold certain positions or engage in certain activities for up to six years.
2 The creation of a public association that proclaims or implements in practice racial, national, ethnic, social or religious intolerance or exclusivity, calling for the violent overthrow of the foundations of the constitutional order, undermining the national security of the state or encroachments on the territorial integrity of the Republic of Kazakhstan, as well as the leadership of such an association –
are punishable by imprisonment for a term of three to seven years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
3 Active participation in the activities of the associations specified in the first or second parts of this article, –
is punishable by a fine in the amount of up to six thousand monthly calculation indices, or correctional labor in the same amount, or restriction of liberty for a term of up to six years, or imprisonment for the same term.
