Article 60. The responsibility of a convicted person for violating the order and conditions of serving a sentence in the form of community service of the Penal Enforcement Code of the Republic of Kazakhstan

Article 60. The responsibility of a convicted person for violating the order and conditions of serving a sentence in the form of community service of the Penal Enforcement Code of the Republic of Kazakhstan

     1. For violation by a convicted person of the order and conditions of serving a sentence in the form of community service, the probation service warns him in writing about the responsibility provided for by the Criminal Code of the Republic of Kazakhstan.

     2. In relation to a convicted person who evades serving a sentence in the form of community service, the probation service sends to the court an idea to replace the unfulfilled part of the punishment imposed for a criminal offense with arrest, and the unfulfilled part of the punishment imposed for a crime with restriction of liberty or imprisonment.

     3. A convicted person is recognized as evading serving a sentence in the form of community service.:

     1) who refused to start carrying out punishment in the form of community service or did not appear more than twice within a month for community service without valid reasons, which include illness and other documented reasons preventing the performance of community service;

     2) twice during the period of serving his sentence, he appeared in a state of alcoholic, narcotic or substance abuse intoxication, confirmed by a medical examination, or, in the absence of such an opportunity, by an employer's commission act;

     3) who has gone into hiding in order to evade serving his sentence;

     4) who has left the Republic of Kazakhstan.

     4. A convicted person whose location has not been established for more than fifteen days from the date of his failure to appear for registration at the probation service is recognized as a fugitive from serving his sentence.
